A gap analysis of the compliance of national legislation, policies and practice with ILO Maternity Protection Convention, 2000 (No.183)

This report presents a comprehensive legal and policy gap analysis of Sri Lanka’s maternity protection framework in relation to the ILO Maternity Protection Convention, 2000 (No. 183). It examines the extent to which national legislation, policies, and practices align with international labour standards on maternity protection, with a particular focus on gender equality, non‑discrimination, and decent work outcomes for women.

Drawing on desk‑based research and key informant interviews with tripartite constituents and legal experts, the analysis reviews core elements of maternity protection, including maternity leave, cash and medical benefits, health protection, employment protection, breastfeeding support, and implementation mechanisms.

The report situates maternity protection within Sri Lanka’s broader socio‑economic and demographic context, including low women’s labour force participation, shifting care responsibilities, and rapid population ageing. It also considers emerging policy developments and international good practices to inform reform pathways.

Concluding with a consolidated set of actionable recommendations, the report outlines strategic priorities to support Sri Lanka’s progressive alignment with Convention No. 183. These include extending coverage to all women workers, strengthening social protection financing mechanisms, improving post‑return employment protection, and enhancing institutional capacity for implementation. The report aims to inform policy dialogue, support evidence‑based reform, and contribute to advancing decent work and gender equality in Sri Lanka.
