Decision concerning the complaint alleging non-observance by Nicaragua of Conventions Nos 87, 98, 111 and 144

Recalling that Nicaragua is bound by all international labour Conventions it has sovereignly ratified, including all obligations arising thereunder or relating thereto, and noting with regret the total lack of meaningful engagement of the Government in addressing the deep concerns expressed by the Committee of Experts on the Application of Conventions and Recommendations and by the Conference Committee on the Application of Standards in their latest examination of the implementation by the Government of Nicaragua of the Conventions that are the subject of the article 26 complaint, the Governing Body decided to establish a commission of inquiry to consider the allegations set out in the complaint, as per the procedure provided for under article 26 of the ILO Constitution, subject to the approval of the related financial implications.

Decision concerning the financial implications of a commission of inquiry

Having decided to appoint a commission of inquiry to examine the complaint alleging non-observance by Nicaragua of Conventions Nos 87, 98, 111 and 144, the Governing Body decided that:

(a) an honorarium of US$350 per day be paid to each member of the commission of inquiry;

(b) the cost of the commission, which is estimated at US$1,262,869, be financed in the first instance from savings that may arise under Part I of the budget for 2024-25 or, failing that, through the use of the provision for unforeseen expenditure, in Part II. Should this not prove possible, the Director-General would propose alternative methods of financing at a later stage in the biennium.
