Methodology
In terms of methodology:
A copy of the first draft of the policy paper on the development of a more effective dispute settlement mechanism in Indonesia will be distributed to the participants prior to the FGD for their advance review and preparation to participate in the FGD.
A summary of the first draft of the policy paper will be presented and discussed in the FGD.
The FGD itself will provide a constructive space in which the first draft of the policy paper can be openly discussed.
Following the FGD, the key points of discussion will be used to inform a subsequent draft of the policy paper.
Background
A key goal of the Labour Standards in Global Supply Chains (LSGSC) project is to develop a study on dispute settlement in Indonesia that outlines the institutions and processes for dispute resolution in Indonesia, identifying some potential improvements (Activity 1.4.2). In particular, to contribute to discussions on the development of a more effective industrial dispute settlement mechanism in Indonesia, the (LSGSC) project currently developing a policy paper that will be able to be used by the tripartite constituents in discussions on developing a more effective industrial dispute settlement in Indonesia.
In this regard, LSGSC has conducted two studies on industrial dispute settlement mechanisms, which provide data and information relevant to identifying major causes of, and potential solutions to, the key issues as a basis for further discussion by the tripartite constituents and relevant stakeholders.
Findings of the two studies have been presented and discussed in a national symposium of labour law practitioners and academics, jointly organized with the Catholic University of Parahyangan, in a Focus Group Discussion (FGD), and in technical meetings with representatives of the tripartite constituents at both provincial and national levels.
To follow-up on the above-mentioned activities, the LSGSC project now plans to conduct a second Focus Group Discussion (FGD) with tripartite constituents and other stakeholders from national and provincial levels in Indonesia. The proposed FGD will be implemented according to these Terms of Reference (TOR).
