Promotion of C190 Ratification and Prevention of Violence and Harassment at Work in Indonesia

Objective

To support the ILO Jakarta initiative that is already underway (through its programmes and projects) in promoting ratification of ILO Convention No. 190 (C190) on Eliminating Violence and Harassment at the World of Work in Indonesia. Based on lessons learnt in supporting policy processes, the Office promotes evidence-based tripartite dialogue to support the government, employers and business, trade unions and social partners in preventing and addressing violence and harassment at work.

Background

Violence and harassment in the world of work, including gender-based violence that occurs in the world of work, is a serious problem. The existence of violence and harassment can cause losses to the company, which can be in the form of: increased absenteeism/ sick leave, decreased motivation, decreased production, employee turnover, loss of managerial time, legal fees, reduced talents, and disrupting the company's brand.

In June 2019, the International Labour Conference in Geneva, representing elements of governments, employers and trade unions from its member countries; adopted ILO Convention No.190 (KILO190) on the Elimination of Violence and Harassment in the World of Work. This is the first international treaty to recognize the right of everyone to a world of work free from violence and harassment, including gender-based violence and harassment. This important instrument was developed by the world of work (representatives of government, employers and workers), and establishes a clear and common framework for preventing and dealing with violence and harassment, based on an inclusive, integrated and gender responsive approach.

Women and girls disproportionally suffer from work-related and gender-based violence and harassment. Further, with the advancement of technologies, new forms of work have emerged. Recent ILO WESO report 2021 reveals that workers on digital labour platforms, in particular women, are prone to facing online discrimination and harassment. The trend of working through cyber space has been accelerated because of the COVID-19 pandemic. Generalized teleworking arrangements may lead to a higher risk of technology-enabled violence and harassment (often known as “cyberbullying”). This program responds to the demand of the tripartite constituents as expressed in the Decent Work Country Programme (DWCP) priority, in particular Country Priority 3: Enhancing protection for vulnerable groups of workers.

Programme Strategy

The programme focuses on promoting gender equality and non-discrimination in a context of future of work and promotes Indonesia’s ratification of C190 that cover all the workers. As the economy and the labour market recover from the pandemic, and as more and more workers are affected by the evolving world of work, the ILO and its tripartite constituents strengthen national capacity and build effective prevention mechanisms to fight against all forms of violence and harassment, including gender-based violence and harassment, and new and traditional forms of violence and harassment.

The approach will be through regulatory policy analysis, public campaigns to increase public awareness; and understanding online gender-based violence that arises as one of the impacts of Covid-19 on the world of work.

This will be implemented by:

  1. Updating and revising the guidelines on prevention and handling violence and harassment (including sexual harassment) at the workplace
  2. Conducting awareness raising campaigns on gender-based violence and harassment together with tripartite and social partners.
  3. Organizing technical capacity development sessions for policymakers and social partners.
  4. Capacity building for tripartite constituents to better understand the prevalence of online violence and harassment, in particular against women and girls; and discuss possible ways forward to preventing and addressing cyberbullying according to the provisions in C190 and R206.
  5. Socialization and collaboration with other ILO projects and UN agencies on the issue of addressing violence & harassment in the world of work in different sector/industry, to tripartite, companies, media, higher education, and society.
