    [L]e Tribunal tient tout d’abord à rappeler que, conformément à sa jurisprudence constante, l’évaluation des mérites d’un fonctionnaire au cours d’une période déterminée fait appel à un jugement de valeur et le Tribunal ne peut se substituer aux organes compétents pour apprécier les qualités, les prestations et le comportement de l’intéressé. Il ne censurera une décision prise dans ce domaine que si celle-ci a été adoptée en violation d’une règle de compétence, de forme ou de procédure, si elle repose sur une erreur de droit ou de fait, si elle omet de tenir compte d’éléments essentiels, s’il a été tiré des pièces du dossier des conclusions manifestement erronées ou si un détournement de pouvoir a été commis (voir, par exemple, les jugements 4543, au considérant 4, 4169, au considérant 7, 4010, au considérant 5, 3268, au considérant 9, et 3039, au considérant 7).
    L’examen de l’évaluation du travail d’un fonctionnaire, avant toute décision concernant le non-renouvellement de son contrat fondée sur des services insatisfaisants, est une obligation fondamentale dont le non-respect est constitutif d’un vice de procédure ayant pour effet de négliger un fait essentiel (voir, notamment, les jugements 2992, au considérant 18, 2096, au considérant 13, et la jurisprudence citée).

    Il est de jurisprudence constante qu’une décision de ne pas prolonger ou renouveler un engagement de durée déterminée est de nature discrétionnaire et ne peut être annulée que pour des motifs limités. Lorsque le non-renouvellement est motivé par le travail insatisfaisant de l’intéressé, la décision peut être contestée avec succès si elle est, par exemple, entachée d’un vice fondamental, tel qu’un vice de procédure, l’omission de prendre en compte un fait essentiel, un détournement ou un abus de pouvoir, ou si elle repose sur une erreur de droit ou de fait (voir le jugement 3743, au considérant 2). Il est également de jurisprudence constante qu’«une organisation ne peut fonder une décision défavorable à un fonctionnaire sur le caractère insatisfaisant du travail de ce dernier si elle n’a pas appliqué les règles établies pour évaluer ce travail» (voir le jugement 3932, au considérant 21). Le Tribunal a également déclaré que si le motif invoqué pour le non-renouvellement d’un contrat de durée déterminée repose sur les services insatisfaisants de l’agent intéressé, qui est en droit d’être informé à temps de ce qu’on lui reproche, l’organisation ne peut fonder sa décision que sur une évaluation de son travail effectuée dans le respect des règles préalablement établies, et à cette obligation s’ajoute celle de donner à la personne concernée la possibilité de s’améliorer (voir le jugement 4289, au considérant 7, et la jurisprudence qui y est citée); en outre, une organisation internationale doit respecter ses propres procédures régissant l’appréciation du comportement professionnel (voir, par exemple, le jugement 3150, au considérant 9).

    La dernière phrase est conforme à la jurisprudence du Tribunal, qui impose à une organisation internationale de respecter ses propres procédures en matière d’évaluation de la performance. En effet, le Tribunal a déclaré ce qui suit dans le jugement 2414, au considérant 24:
    «Les considérations fondamentales qui amènent à conclure qu’une organisation doit respecter les règles qu’elle a édictées impliquent également qu’elle ne peut fonder une décision faisant grief à un fonctionnaire sur le fait que son travail n’est pas satisfaisant si elle n’a pas respecté les règles établies pour évaluer ce travail. De même que les décisions de ne pas accorder à la requérante ses augmentations de traitement ne pouvaient être justifiées par le carac tèreinsatisfaisant de son travail puisque les règles applicables n’avaient pas été respectées, les décisions de ne pas convertir ni renouveler son contrat ne peuvent elles non plus reposer sur une telle justification.»

    [L]e Tribunal tient […] à rappeler sa jurisprudence en la matière: «Les principes régissant l’examen par le Tribunal de la contestation des rapports d’évaluation du comportement professionnel sont bien établis. En effet, ils sont exposés dans le jugement 3378, au considérant 6. Le Tribunal reconnaît que ces rapports relèvent du pouvoir d’appréciation de l’Organisation et ne peuvent être annulés ou modifiés que pour un vice de forme ou de procédure, une erreur de fait ou de droit, l’omission de tenir compte de faits essentiels, un détournement de pouvoir ou des déductions inexactes tirées du dossier» (voir le jugement 3842, au considérant 7). Le Tribunal a de même considéré qu’en principe «l’organe appelé à [entériner un rapport d’évaluation d’un fonctionnaire] reconnaîtra au notateur une large liberté d’expression. Selon les cas, les observations que le fonctionnaire visé formule sur le rapport peuvent remédier aux erreurs dont celui-ci pourrait être entaché. Un refus d’approbation ne se justifie, d’une manière générale, que si l’auteur du rapport s’est trompé clairement sur des points importants, s’il n’a pas pris en considération des éléments décisifs, s’il est tombé dans de graves contradictions ou s’il était animé d’un parti pris démontré. Le simple fait que les appréciations d’un notateur pour une période déterminée diffèrent de celles qu’un autre notateur a émises, pour une période antérieure ou postérieure, n’implique pas nécessairement l’existence d’un parti pris» (voir le jugement 724, au considérant 3; voir également le jugement 2318, au considérant 4).
