Decision

1. The case is referred back to the ITU for further action as stated in consideration 4.
2. The ITU shall pay the complainant moral damages in the amount of 20,000 Swiss francs.
3. It shall also pay her costs in the amount of 1,000 Swiss francs.
4. All other claims are dismissed.

The ITU’s erroneous legal assessment has resulted in an unacceptable delay in the execution of Judgment 2551 and consequently in the final settlement of the dispute. Having regard to all the circumstances of the case, the Tribunal sees fit to award moral damages to the complainant in the amount of 20,000 Swiss francs.
