Mauritania - Working time - 2011


Duration

General

After the reference period established in art. 178 (12 months), the worker is entitled to 1,5 day of leave per month of effective service.

  • 2006: In this case, collective or individual agreements may foresee a longer time work period entitling to take leave, not superior to 30 days. In all cases, right to leave may be deferred upon agreement between the parties, but the work period may not exceed 3 years. Additional days are granted according to seniority of worker in the undertaking, as provided for in regulations or collective agreements. Family mothers are entitled to 1 additional annual leave day per each child under 14 years' age. One and a half weekdays per month worked for workers of at least 18 years' age. Two weekdays per month worked for workers under 18 years' age. Right to leave starts after 12 months of work for above workers. Two weekdays per month worked for workers occupied far away from their home. (form of compensation - "indemnité d'éloignement").

Exceptions

3 days per month for employees whose normal residence is not in Mauritania.
One additional day annual leave is granted for 10-15 years of seniority, two additional days for 15-20 years seniority and 3 days for a seniority exceeding 20 years.

Amount

Duration

General

Subject to subsection (7), every worker, other than a part-time worker, who remains in continuous employment with the same employer for a period of 12 consecutive months shall be entitled, during each subsequent period of 12 months while he remains in continuous employment, to 20 working days’ annual leave or such similar leave under any other name.

Notwithstanding subsection (1), every worker shall be entitled to 2 days’ leave in every year, in addition to the leave specified in:
(a) subsection (1);
(b) any other enactment;
(c) any agreement;
(d) any collective agreement; or
(e) any award following arbitration.

Payment

A daily paid worker who remains in continuous employment with the same employer for a period of 12 consecutive months shall be entitled during each subsequent period of 12 months while he remains in continuous employment, to a normal day’s pay in respect of every public holiday, other than a Sunday, on which he is not required to work that occurs while he remains in the continuous employment of the employer.

General

Every employee, having worked at least 6 months continuously in the same company, is entitled to paid annual leave as it follows, unles there are more favourable clauses in the collective agreement, company rules, or in the labour contract:

1. 1 and 1/2 day of effective work for every month of service.
2. 2 days of effective work for every month of service for those aged under 18.

The paid annual leave is increased in one and a half day of effective work for an entire period, continue or not, of 5 years of service. However, this increase cannot be accumulated when the total annual leave has reached the limit of 30 working days.

An "effective day of work" day is that which is not a weekly rest day, a holiday and general holidays of the company.

The working month is defined as: 26 effective working days or 191 working hours in the non agricultural sector or 208 in the agricultural sector.

The employee has the right to receive during his/her annual leave the salary equivalent to that he/she would receive if he/she was in service.

Contract workers with at least 26 days of service with the same employer or undertaking are entitled to an indemnity equivalent to 1 and 1/2 day (2 days for the young workers under 18 years) per 26-day period of work.

General

Except for more favorable provisions from collective conventions between employer and worker or individual employment contract, every worker shall be entitled to a paid leave at the employer’s expenses, on the basis of one and a half working days per month of effective continued work. Official holidays shall not be considered as part of the annual paid leave. The worker shall benefit from one working day per year of annual paid leave for every three years of experience in the same institution. However, annual paid leave, in any case, can not exceed twenty one (21) working days.
