LEGAL DEFINITIONS


Employee/worker

“Workman” means any person who has entered into or works under a contract with an employer whether under a contract with an employer whether the contract be by way of manual labour, clerical, work or otherwise, be expressed or implied, oral or in writing and whether it be contract of service or of apprenticeship or a contract personally to execute any work or labour.

Employer

“Employer” means any person or body of persons, corporate or unincorporated, hiring or employing the labour or service of any workman.

Wage

“Normal wages” includes any salary or money contracted to be paid or required by law to be paid or given as a recompense, reward or remuneration for any such services, work or labour done or to be done.

MINIMUM WAGE FIXING

Scope

The legislation provides a general minimum wage rate applying for all workers except for:
- workers employed in casinos, hotels, restaurants or other related workers;
- security guards;
- domestic workers;
- watchmen;
- shop employees; and
- workers employed in the manufacturing sector,
For these categories of workers minimum wage rates are provided by specific Orders.

Excluded categories

Certain categories of workers are excluded from the scope of application of the National Minimum Wage rate, namely:
- workers employed in casinos, hotels, restaurants or other related workers;
- security guards;
- domestic workers;
- watchmen;
- shop employees; and
- workers employed in the manufacturing sector.

Minimum wage level(s) in national currency

The National Minimum wage rate is fixed in EC$ 8.00 (USD$ 3.00) per hour.

In-kind allowances

The entire amount of the wages shall be paid in legal tender and any compensation made in any other form shall be illegal, null and void, provided that the Labour Commissioner may permit or prescribe the payment of wages by bank cheque, postal order or money order in cases where payment in this manner may be desirable, or where any collective agreement or arbitration award so provides, or where the consent of the worker so to do is obtained.

The wages shall be paid in Eastern Caribbean currency, or, with the consent in writing of the worker concerned, in any other currency which is legal tender in the Colony and not otherwise, and if any such agreement or contract the whole or any part of such wages is paid in any other manner, such agreement or conduct shall be illegal, null and void.

However, it shall not be illegal providing an employee with food, dwelling-place or other allowances or privileges in addition to any wages as a remuneration for his services.

Scheduled frequency of adjustment

The legislation does not state the frequency of adjustment of the national minimum wage rate.

Enforcement mechanisms


Labour inspection

Labour Commissioner shall be charged to safeguard and promote the general welfare of workers in the Colony. For this purpose, he and appointed labour inspectors, shall carry out inspections in order to verify that Orders on wages, hours and other labour regulations are adhered to.

These measures may involve verifying books, registers or other documents and carrying out work-place inspections.

Fines in national currency for non-respect of legislation

In case of non respect the legislation, the infractor may be imposed a fine not exceeding one hundred dollars on summary conviction.
