Vessel abandoned in Durban, South Africa on 3 January 2022, having on board 10 seafarers from India (9) and Iran (Islamic Republic of,)(1), who have more than 4 months owed wages. Prior to 5 January 2022 they spent two months at anchor where they had to eat mostly rice every day.

Have contacted the owner, flag state, P&I club and South African maritime authorities. Have also asked a local contact to visit the vessel to check on crew wellbeing.

All crew want repatriation.

The owner has offered the crew to accept 2 months wages and repatriation, which has been accepted because the stress of waiting and not being able to provide for their families. The ITF advised against this action.
The crew have received their 2 months wages and will disembark the vessel on 22nd February 2022

The owner of this vessel also owns the PSD2 which has reportedly been in Durban port for 4 years.

According to the procedures governing the joint ILO/IMO Database o Abandonment of Seafarers, ILO sends reports regarding new cases directly for verification to IMO, and we then check the information given on the IMO number, flag, type of vessel, company, and registered owner. Please find herewith attached information, that is also publicly available on both IMO GISIS and EQUASIS, which identifies as the operator/manager: Bourbon Offshore Greenmar Ltd, as here below:

Regarding the new abandonment case of the PSD 104, it will be highly appreciated if IMO could kindly provide us with additional information, especially on the operator /manager which has been mentioned as Mauritius. This will help us produce further comments on the matter.

Our understanding is that Mastshipping Lda (IMO Company no 1986477) no longer owns “PSD 104” (IMO 9191802) since March 2021.

The certificate of registry issued in July last year by the Zanzibar Maritime Authority which was attached in your previous e-mail mentions that the registered owner is Quartet Solutions LLC (IMO Company no 6283117) from Oman.

IHS Maritime and GISIS records also have this information.

Vessel has been arrested by the crew with legal assistance from the ITF. A petition to sell the vessel has been made.
Working with the local Mission to Seafarers and SAMSA the ITF has provided funds for provisions and fuel. Between us we are also arranging for the seafarers to be vaccinated.
The owner continues to try and coerce the crew into accepting less than they are entitled to.
The owner of this vessel also owns the PSD2 which is also abandoned in Durban.

Greetings from the Mauritius High Commission.

We wish to refer to your emails dated 01 February 2022 and 17 February 2022 regarding the abandonment case of the PSD 104.

2. The Mauritius High Commission wishes to bring to your attention the following:

(a) The Director of Bourbon Offshore Greenmar Ltd has confirmed that Bourbon Offshore Greenmar is not managing or own any Tanzanian registered vessel by the name PSD 104, as previously mentioned in the ILO Database.

(b) The Director of Bourbon Offshore Greenmar Ltd has also informed that Malila previously owned by MASTSHIPPING – SHIPPING, SOCIEDADE UNIPESSOAL LDA FUNCHAL, PORTUGAL was ship managed by Bourbon Offshore Greenmar until it was sold to Quartet Solutions LLC, Oman - the new owner. The sale was concluded by 11 March 2021.

(c) He has also provided the following documents:

i. Malila Bill of Sale.
ii. Malila Transcript of Deletion from the previous Flag. (Refer to page 2 indicating the acknowledgement of flag on the sale of the vessel).
iii. Malila Protocol of Delivery (PODA).
iv. Memorandum of Agreement on the sale of the vessel.

(d) As per the information received, the details of the owner of the vessel PSD 104 and his representative are as follows:

3. In this regard, attached are the documents as provided by the Director of Bourbon Offshore Greenmar Ltd which are listed in paragraph 2c above.

4. In light of the above, the Mauritius High Commission is requesting to remove the name of the Republic of Mauritius from the IMO/ILO database for abandonment of seafarers with respect to the vessel PSD 104.

5. Much grateful if you could kindly acknowledge receipt of the email and keep us updated on the matter.

The vessel remains arrested and the Iranian owner continues to refuse to pay the costs of the arrest, port dues and the reimbursement of the food and water provided by the ITF. The vessel is currently unmanned.

The ten crew on board have now been repatriated.

The Iranian owner also owns the PSD2, also in Durban and abandoned.

All the crew received outstanding wages. The arrest has been lifted.
