Circonstances:The vessel is under arrest by the mortgagee bank. The crew is owed outstanding wages and wish to be repatriated.

The Liberian flagged vessel TINA, IMO No. 9215749, is owned by Astrale and managed by Athenian Ship Management Inc. The vessel maintained a Certificate of Insurance in respect of Seafarer Repatriation Costs and Liabilities as required under Regulation 2.5 and Standard A2.5.2 of MLC 2006 issued by The London P&I Club.

On September 13, 2018, the Liberian Administration was informed by International Transport Workers' Federation (ITF) that seafarers onboard the TINA had been arrested by the Mortgagee Bank on September 11, 2018 in Singapore. The seafarers were owed an unspecified amount of unpaid wages and requested to be repatriated and were seeking assistance in ensuring that the welfare and contractually obligations are met.

On September 13, 2018 - the Liberian flag Administration reported the matter to The London P&I Club of the abandonment, due to shipowners failure to pay contractual wages in excess of two months, lack of food, water and other supplies and repatriation. The seafarers were on board the ship and actively employed under valid employment agreements during the validity of the certificate of insurance from 20 February 2018 to 24 August 2018, are entitled to their unpaid wages.

On September 17, 2018 - The London P&I Club advised the Administration that “owner of the vessel is no longer entered with the Association, cover having been terminated…we are not aware of whether the vessel has financial security coverage to cover abandonment…the MLC certificate lapsed on August 26, 2018. The Association has not received (while the MLC certificate was valid or otherwise) any notification or request by the crew for the Association to intervene in any way…the Association has no obligations, as financial security provider, towards the crew. The fact that wages may have been unpaid while the MLC certificate was valid does not mean that the Association’s obligations continue in the present case…the mortgagee bank, Piraeus Bank, is understood to have taken control of the vessels.”
London P&I Club maintained that it owes no obligation to the seafarers.

18 novembre 2018: Autres
18 December 2018; The Liberian Administration followed up with Evic Human Resource Management about the issue, and the it was reported by the latter that 12 out of the 22 seafarers on board the TINA were successfully repatriated.

janvier 2019: Navire vendu, ou devant être vendu
7 January 2019; The Liberian Administration received a copy of a Court Order from Supreme Court of Singapore dated 03 January 2019 ordering the judicial sale of the vessel TINA. The Liberian Administration was also informed that the seafarers has appointed a Singapore based law firm Gurbani and Co. LLC for settlement of wages and other claims.

11 January 2019; The Liberian Administration was informed by Evic Human Resource Management that the last remaining 10 seafarers from the TINA were repatriated. TINA was judicially sold, but the court order provided that no one is to make any application for payment out from the sale proceeds for 90 days from the date of sale.. As such, any application for payment out can only be made 90 days later and this would be dependent on the Court/Judge's schedule.

Crew unpaid salary claim June 1, 2018 – Jan. 4, 2019 received one month salary advance last Nov. 2018 arranged by the bank.

24 March 2019; the Liberian Administration followed up with Evic Human Resource Management for updates on settlement of crew wages, and was advised that for TINA they are waiting for the lifting of the 90 days moratorium to liaise further on the settlement of crew wages.

12 out of the 22 seafarers on board the TINA were successfully repatriated in December 2018. In January 2019 the last remaining 10 seafarers from the TINA were repatriated.
