HIV and AIDS Act 2006 (No. 31 of 2006). - Adoption: 2006-12-22 | MUS-2006-L-75309 The Act provides measures for the prevention and containment of HIV/AIDS. Article 1 states "Any person who is HIV-positive or has AIDS shall not be considered as having a disability or incapacity by virtue of any enactment and his status or presumed status shall not be used as a ground to discriminate against that person". Article 6 states "No person shall induce or cause another person to undergo an HIV test - (a) as a condition for employment, continued employment benefits and promotion or continued employment of the other person."

Sex Discrimination Act, 2002 (No. 43 of 2002). - Adoption: 2002-12-21 | MUS-2002-L-64400 Comprehensive legislation prohibiting all forms of gender discrimination and sexual harassment in certain areas of public policy. Divided into 6 parts. Part 1 contains preliminary provisions. Part 2 provides for protection against unlawful discrimination. Prohibits discrimination on the grounds of sex, marital status, and pregnancy or family responsibility. Also deals with discrimination in employment. Part 3 deals with discrimination in education; provision of goods, services or facilities; accomodation; disposal of property; companies, partnerships and other associations, and clubs. Part 4 sets forth prohibition of sexual harassment. Person sexually harasses other person where, in circumstances in which a reasonable person would have foreseen that that other person would be humiliated, offended or intimidated, he (a) makes an unwelcome sexual advance, or an unwelcome request for a sexual favour to that other person; or (b) engages in any other unwelcome conduct of a sexual nature towards that other person. Part 5 deals with inquiries and civil proceedings; Part 6 contains penal provisions.
