The Act make provisions for the care, protection and assistance to children, and to provide for matters related thereto. It implements the African Charter on the Rights and Welfare of the Child and the United Nations Convention on the Rights of the Child. It includes protection of children who have been trafficked, in cases of forced labour and slavery as well as child labour, in respect of a child under the age of 16.

Child Protection (Amendment) Act 2005 (Act No. 34 of 2005). -

Inserts new sections 13A to 13C into the principal Act. Section 13A deals with child trafficking. Any person who wilfully recruits, transports, transfers, harbours or receives a child for the purpose of exploitation (including for prostitution, forced labour, slavery servitude or removal of organs) is guilty of an offence under the Act. It also deals with trafficking between Mauritius and another country. All documents concerning the identity of the victim are not to be published in the press. A person convicted of an offence under this section is liable to 15 years imprisonment. Section 13B deals with the abandonment of a child and section 13C deals with abduction. Sections 18 and 21 are also amended, as are sections 262A to 271 of the Criminal Code.

Provides for establishment of office of Ombudsperson for Children. Objects of Ombudsperson for Children are (a) to ensure that rights, needs and interests of children are given full consideration by public bodies, private authorities, individuals and associations; (b) to promote rights and interests of children; and (c) to promote compliance with UN Convention on the Rights of the Child. This includes investigating suspected or reported cases of child labour. Also regulates powers and procedures of Ombudsperson.

Amends numerous Acts with regard to child protection. Inter alia, amends the Explosives Act to prohibit the handling of explosives by minors, and adds a new section to the Shops Act to prohibit the employment of a child of a shop owner if the child is below the age of 15.

Sets forth comprehensive provisions for the protection of children through the Permanent Secretary of the Ministry responsible for the subject of Child Development and Family Welfare. Children may be placed in emergency protective custody if they are subject to sexual abuse, are caused to beg or engage in prostitution, or have access to a brothel, gaming house or a video club.
