    The TRRC Act provides for the establishment of the historical record of the nature, causes and extent of violations and abuses of human rights committed during the period July 1994 to January 2017 and to consider the granting of reparation of victims.

    The main objectives of the TRRC, pursuant to Section 13 of the Act, are to:

    (a) create an impartial historical record of violations and abuses of human rights from July 1994 to January 2017, in order to –
    (i) promote healing and reconciliation,
    (ii) respond to the needs of the victims,
    (iii) address impunity, and
    (iv) prevent a repetition of the violations and abuses suffered by making recommendations for the establishment of appropriate preventive mechanisms including institutional and legal reforms;

    (b) establish and make known the fate or whereabouts of disappeared victims;

    (c) provide victims an opportunity to relate their own accounts of the violations and abuses suffered; and

    (d) grant reparations to victims in appropriate cases.

    - A vice-chairperson who has acquired not less than five years expertise in his or her field; and
    - three other members.

    This Act makes provision with respect to the management and conservation of fisheries resources in The Gambia, regulates fishing by nationals of The Gambia on the High Seas and prescribes rules relative to aquaculture, fish processing and import and export of fisheries products.
    The Act consists of 107 sections divided into 17 Parts: Preliminary (I); Administration (II); Fisheries Advisory Committee (III); Fisheries conservation, management and development (IV); Fisheries Fund (V); General licence requirements (VI); Local licensing requirements (VII); Foreign licensing provisions (VIII); High Seas fishing (IX); Aquaculture (X); Fish processing, import and export (XI); Prohibitions (XII); Powers of authorized officers (XIII); Fisheries observers (XIV); Sale, release and forfeiture of retained property (XV); Jurisdiction and evidence (XVI); Miscellaneous (XVII).
    The Secretary of State responsible for fisheries shall be charged with the administration of this Act. The Director of Fisheries, under the supervision of the Secretary of State, shall be responsible for the implementation of the policy and measures regarding the fisheries sector and aquaculture and shall issue licences. The Fisheries Advisory Committee, established by this Act, shall advise the Secretary of State on policies required for the implementation of this Act.
    The Director shall draft plans for the management and development of fisheries and aquaculture and may establish management committees for each plan. The Secretary of State may declare special management areas for the purpose of community-based fisheries management and other stated purposes. For purposes of community-based fishing, the Secretary of State may also establish Community Fisheries Centres.
    The Fisheries Development Fund, established under this Act, shall be used for, among other things, fisheries monitoring, control and surveillance.
    The Act sets out general licence requirements and specific conditions for local fishing vessels and foreign fishing vessels. As for foreign fishing, the Act sets out conditions of access and contains provisions regarding behaviour of foreign fishing vessels in waters of The Gambia. The Act prescribes the requirement of a licence to be issued by the Director and an authorization of the Secretary of State to fish on the High Seas and the Director shall maintain a record of High Seas fishing vessels.
    Provisions regarding aquaculture deal with a variety of matters including; licensing, conditions, protection of the aquatic ecosystem, introduction of exotic species, public leasing of lands, exclusive rights to farm and harvest, restoration of the environment and control of fish diseases.
    One Part of the Act sets out a variety of prohibitions including; the use of explosives in fishing, possession of prohibited gear, use of industrial driftnets, discharge of waste and import of illegal fish.
    Other provisions of the Act concern, among other things, powers of persons designated by the Secretary of State as authorized officers, measures of control and enforcement and regulation-making powers of the Secretary of State.

    The Act establishes the National Agency Against Trafficking in Persons and regulates its composition, powers, functions and responsibilities. It prohibits all forms of trafficking in persons and provides for heavy penalties (life imprisonment for trafficking persons under 18 years or when the trafficking includes the rape or death of the victim of trafficking and minimum 15 years imprisonment to a maximum of life imprisonment for trafficking in adults). There are also provisions concerning the protection of victims of trafficking including ensuring that they are not subject to discrimination, that they have access to adequate medical, psychological and legal services and that their safety and integrity is taken into account when dealing with victims of trafficking.

    This Act provides in 62 articles divided into 13 Parts the principles of environment protection and the instruments to carry out an environment protection policy in the Gambia.
    Part 1 contains not less than 13 pages of definitions used in the Act. Part II outlines the general principles of environment protection and confers certain powers upon the national Environment Agency established under Part III. Part III provides for a Council for the protection of the environment to be headed by the President of the Gambia and having several ministers as its members, and the establishment of the Agency aforementioned as a corporate body. The Agency shall coordinate the environment policy of the Government and function as the secretariat of the Council. Several national and local committees are also established. The Action Plan, prepared by the Agency shall be the key instrument for national environment planning. Also local planning units shall prepare local environment plans which shall be co-ordinated with plans made under the Physical Planning and Development Act (No. 1 of 1991) (Part IV). Part V requires a developer to submit environment project briefs and environmental impact statements for projects listed in the Schedule. Section 25 provides for environmental audits. The environmental standards specified in Part VI shall be established by the Agency. Part VII, dealing with environmental management, contains also several sections on coastal zone management. Part VIII provides summarily for the control of various forms of pollution. The remaining Parts deal with inspection and analysis (IX), education (X), offences (XI), legal proceedings (XII) and miscellaneous matters (XIII). (completed by 1 Schedule)

Regulation 20 concerns the disposal of refuse. An adequate supply of wholesome water shall be provided at suitable points in every factory.

    The 47 rules are divided into 9 Parts: Fees, rents and royalties (I); prospecting rights (II); Exclusive prospecting licenses (III); Application by holder of prospecting right or exclusive prospecting license to retain or dispose of minerals (IV); Mining rights (V); Mining leases (VI); Tender for exclusive prospecting licenses, mining rights and mining leases in respect of areas in a tract of land in which any mineral has been discovered by Government (VII); Water Rights (VIII); Miscellaneous provisions (IX).
    Water may be diverted and impounded for the purpose of mining operations without a water right by holder of a mining lease or mining right or an applicant for a mining right to whom a permission to mine has been granted under section 23 of the Act. Subject to condition set out in rule 45. Application for water rights shall be accompanied by a plan showing the point of intake on a watercourse, and other specified items.

  50. Gambie - - Loi

    Forced Labour Act (No. 8 of 1934).

    Sets forth prohibition of forced labour. In the event of war, famine, earthquake, violent epidemic, invasion by animal, insect or vegetable pests, flood or fire or any other circumstance endangering existance or well-being of population, the President may require labour from any person. Also provides for power of district authorities to require labour of inhabitants for certain public works.
