    These Regulations replace, in relation to British external waters, the Offshore Installations (Safety Case) Regulations 2005 to provide for the preparation of safety cases for offshore installations and the notification of specified activities to the competent authority. The “competent authority,” for the purposes of these Regulations is the Health and Safety Executive (the “Executive”) and the Secretary of State acting jointly. The competent authority is appointed to carry out the functions imposed on such an authority by Directive 2013/30/EU on safety of offshore oil and gas operations and amending Directive 2004/35/EC (“the Offshore Safety Directive”) (OJ No L 178, 28.06.13, p.66). A “safety case” is defined in the Regulations as a document containing specified information relating to the management of health and safety and the control of major accident hazards and containing the relevant particulars specified in Schedule 6 or 7 to the Regulations.

    These Regulations, which are based on similar regulations in force in the United Kingdom (S.I. 1994/3140), impose requirements with respect to design and management aspects of construction work. The obligations are imposed various persons (i.e the client, developer, designer, planning supervisor, principal contractor and contractors) and on employers and self-employed persons. A developer carrying out a project for a domestic client in specified circumstances must comply with certain obligations as if he were the client. The construction phase of a project must not begin unless a health and safety plan has been prepared and the client must provide the planning supervisor with information about the state or condition of specified premises and make information in a health and safety file available for inspection.

    (c)Council Directive 86/298/EEC (OJ No. L186, 8.7.86, p. 26) relating to the rear-mounted roll-over protection structures of narrow-track wheeled agricultural and forestry tractors; or
    (d)Council Directive 87/402/EEC (OJ No. L220, 8.8.87, p. 1) relating to the roll-over protection structures mounted in front of the driver’s seat on narrow-track wheeled agricultural and forestry tractors,
    shall be deemed to be approved and correctly marked in accordance with regulation 3 of the 1974 Regulations if it is fitted to and for use with a tractor of the type to which it was attached when tested pursuant to the relevant Directive specified above, and the driver-perceived noise level is within either of the limits specified in Article 2.1 of Council Directive 77/311/EEC (OJ No. L105, 28.4.77, p. 1) (relating to the driver-perceived noise level of wheeled agricultural or forestry tractors) when measured in accordance with the relevant Annex to that Directive.

    Requires, inter alia, every fisherman born on or after 1954-03-01, or engaged on a fishing vessel registered in the United Kingdom (other than a certified deck officer or certificated engineer officer) to undergo training in basic survival at sea, basic fire fighting and prevention and basic first aid at an establishment approved by the Secretary of State.

    Revokes the 1976 Regulations of the same name which provide for fire precautions to be taken in certain premises which do not require a fire certificate under the Fire Precautions Act 1971. From the date of revocation, the Fire Safety and Safety of Places of Sport Act 1987 (Commencement No. 5) Order 1989 brings into force provisions amending the Fire Precautions Act 1971, including a new section 9A of that Act which imposes a general statutory duty to provide all premises which are exempt from the requirement for a fire certificate with adequate means of escape in case of fire and means of fighting fire.
