    These Regulations generally prohibit the compilation, use, sale or supply of blacklists containing details of trade union members and activists whose purpose is to discriminate against workers on grounds of trade union membership or trade union activities (regulation 3). The Regulations give rights to persons to complain to the employment tribunal in certain circumstances. These rights arise where a person has been refused employment (regulation 5) or employment agency services (regulation 6) or been subjected to a detriment (regulation 9) for a reason related to a blacklist. The Regulations make amendments to the Employment Rights Act 1996 to also give a right of complaint to the employment tribunal where a person has been unfairly dismissed for a reason relating to a blacklist. The Regulations provide for minimum and maximum compensation available from the employment tribunal in specified cases. Persons who have suffered or will suffer a loss due to the use or apprehended use of a blacklist may apply to the Court for damages, including damages for injury to feelings, and for orders restraining or preventing the compilation, use, sale or supply of the blacklist (regulation 13). A person cannot claim compensation from the employment tribunal and damages from the Court in respect of the same conduct (regulation 13(5)). Where a person is pursuing a complaint before the employment tribunal, that person is permitted to apply to the Court for orders restraining or preventing the compilation, use, sale or supply of the blacklist in question (regulation 13(4)).

    This Order appoints 6th April 2009 as the day upon which the Code of Practice on Disciplinary and Grievance Procedures which is being issued by ACAS under section 199 of the Trade Union and Labour Relations (Consolidation) Act 1992 will come into effect. Article 3 provides that the ACAS Code does not apply in circumstances where the statutory disciplinary and grievance procedures apply. The repeal of the statutory disciplinary and grievance procedures is subject to the transitional arrangements in the Employment Act 2008 (Commencement No. 1 Transitional Provisions and Savings) Order 2008.     Sections 1-7 make certain changes to the law relating to dispute resolution in the workplace.
    Sections 8-12 make changes to the enforcement of the national minimum wage
    Section 13 clarifies that Cadet Force Adult Volunteers do not qualify for the national minimum wage.
    Section 14 amends section 44 of the National Minimum Wage Act (NMWA) 1998 to broaden the type of expenses that can be reimbursed to voluntary workers without triggering eligibility for the national minimum wage.
    Sections 15-16 amend the employment agency standards enforcement regime by making offences under the Employment Agencies Act (EAA) 1973 each way offences and conferring additional inspection powers on the Employment Agency Standards Inspectorate.
    Section 17 enables partners to be prosecuted where offences have been committed by partnerships in Scotland and any of the partners are culpable.
    Section 18 allows officers appointed under the NMWA 1998 and officers appointed under the EAA 1973 to share information with each other for the purpose of their respective enforcement functions.
    Section 19 amends trade union membership law to ensure UK compliance with the ruling of the European Court of Human Rights on Aslef v UK 1. The amendments enable trade unions to apply membership rules which prohibit individuals who belong or who have belonged to a particular political party from membership of the trade union provided certain conditions are satisfied.
    Sections 20-23 deal with general details of the Act.

New provisions include that if upon a pre-hearing review the tribunal considers that a party's contentions have no reasonable prospect of success, it may order that party to pay a specified sum; in an appeal in a case involving allegations of sexual misconduct, a tribunal may make a reporting restriction order.

    Apart from regulation 8, the Regulations are made in consequence of the judgement of the European Court of Justice in cases C382/92 and C383/92, Commission of the European Communities vs the UK, ([1994] I.C.R. 664) in which the Court held that the UK had failed to comply with the requirements of Directives 77/187 (OJ No. 1977 L61/26) and 75/129 (OJ No. 1975 L 48/29) by failing to provide for consultation of workers' representatives where there was no recognised trade union. The Regulations require the employer to consult either elected representatives of the employees or representatives of a recognised trade union where there are to be redundancies or a transfer of the undertaking. The Regulations also provide protection for elected representatives against dismissal and against being subjected to any other detriment and confer on them a right to time off with pay to carry out their functions.

    Amends and largely restates the law in relation to trade unions and industrial relations. The Order is divided into 11 Parts and 4 Schedules. Part II regulates trade union administration, Part III trade union elections, and Part IV trade union membership. Part V regulates unions' political activities, Part VI union amalgamations and similar matters, and Part VIII assistance for certain legal proceedings. Part IX establishes rules for industrial action; Parts X and XI provide miscellaneous amendments, affecting, inter alia, servants of the Crown. The Schedules list legislation affected by the Order.
