This Act is also the vehicle for the Government to give effect to the EEA EFTA Separation Agreement between the UK and Norway, Iceland and Liechtenstein, and the Swiss Citizens’ Rights Agreement between the UK and Switzerland.

    This Order amends the Constitution of Anguilla. It changes the title of Chief Minister to Premier and introduces a limit of two consecutive terms for the Premier. It substitutes the term Anguillian for a person who belongs to Anguilla, and revises the categories of people who qualify as Anguillians. It also makes some changes to the qualifications for elected membership of the House of Assembly and the qualifications of voters, and enables the establishment by legislation of an island-wide single electoral district in addition to the single-member electoral districts into which Anguilla is divided. With effect from the next dissolution of the House of Assembly, it abolishes the office of nominated member of the House of Assembly.

    This Order establishes a new Constitution for the Cayman Islands, to replace the Constitution of 1972. The new Constitution includes, a Bill of Rights setting out the fundamental rights and freedoms of the individual and provisions for their enforcement. It provides for a Governor as Her Majesty's representative in the Islands, and for a Premier and other Ministers who form a Cabinet together with the Deputy Governor and the Attorney General. It provides for an elected Legislative Assembly, which together with Her Majesty forms the Legislature. It provides for a Grand Court and a Court of Appeal as superior courts, and a Judicial and Legal Services Commission to advise on judicial and senior legal appointments. Provision is also made for a Human Rights Commission, a Commission for Standards in Public Life, and a Constitutional Commission. A new National Security Council is established, as is the new office of Director of Public Prosecutions. Provision is also made for the public service, public finance, a Complaints Commissioner, a Register of Interests, and freedom of information.

    Mindful that the people of the Virgin Islands have expressed a desire for their Constitution to reflect who they are as a people and a country and their quest for social justice, economic empowerment and political advancement;

    Recognising that the people of the Virgin Islands have a free and independent spirit, and have developed themselves and their country based on qualities of honesty, integrity, mutual respect, self-reliance and the ownership of the land engendering a strong sense of belonging to and kinship with those Islands;

    Recalling that because of historical, economic and other reasons many of the people of the Virgin Islands reside elsewhere but have and continue to have an ancestral connection and bond with those Islands;
    Accepting that the Virgin Islands should be governed based on adherence to well-established democratic principles and institutions;

    Affirming that the people of the Virgin Islands have generally expressed their desire to become a self-governing people and to exercise the highest degree of control over the affairs of their country at this stage of its development; and

    Noting that the United Kingdom, the administering power for the time being, has articulated a desire to enter into a modern partnership with the Virgin Islands based on the principles of mutual respect and self determination;

    Now, therefore, the following provisions have effect as the Constitution of the Virgin Islands.

    This Order establishes a new Constitution for Gibraltar. The new Constitution includes an updated Chapter on the fundamental rights and freedoms of the individual. It provides for a Governor as Her Majesty’s representative in Gibraltar. It establishes a legislature for Gibraltar consisting of Her Majesty and an elected Parliament, and a Council of Ministers appointed from among the elected members of the Parliament. It provides for a Supreme Court and a Court of Appeal for Gibraltar, and for appeals to Her Majesty in Council, and makes provision for public finance and for the public service of Gibraltar. It establishes a Public Service Commission, a Specified Appointments Commission and a Judicial Service Commission, each with executive powers subject only to an exceptional power of veto by the Governor. It also establishes a Gibraltar Police Authority, provides for an elected Mayor of Gibraltar, and makes provision regarding Crown lands in Gibraltar.

    This Order revokes the Gibraltar Constitution Order 1969, which established the previous Constitution of Gibraltar.

The Act modifies the jurisdiction of the Judicial Committee of the Privy Council and removes the right of the Lord President of the Council to sit judicially.
