    "The employer may terminate the labour contract as a result of the total or partial closure of the establishment, the downsizing of its activities, the replacement of the production system by another in a way that affects the number of the workforce, provided the contract is only terminated following the notification of the Ministry of the reason of termination thirty days before the date of the notification of the worker of the termination.
    In case of partial closure, the contract of the Bahraini worker who is as competent and experienced as his foreign counterpart in the establishment shall not be terminated."

    Anyone who forces someone to commit such acts will also face the same penalties.

    Violators will be sentenced to a minimum of one year in prison, if the crime is committed in a place empty of people.

    "All communications between political societies and diplomatic missions and consulates in the Kingdom of Bahrain and representatives of foreign governments have to be coordinated with the Ministry of Foreign Affairs, and in the presence of one of its own representatives or any other official entrusted to do so.
    Moreover, any political society wishing to make such contacts shall notify the Ministry of Justice and Islamic Affairs at least three days in advance, which in turn will coordinate with the Ministry of Foreign Affairs. The same rules apply to communications of political societies with any foreign political organizations abroad".

    Article 1: The text of articles 2, 3 and 7 paragraph 2 of the Decree-by-Law No. 27 for the year 2002 regarding establishing the Constitutional Court shall be replaced with the following provisions:-

    "Article 1: In applying the provisions of this Law, the word "court" denotes the "Constitutional Court"; in other words "court member", "court chairman", deputy chairman and members of the court".

    "Article 3: The court shall comprise a chairman, deputy chairman and five members appointed under a Royal Ordinance to succeed him for a term of five years renewable once. In the event of the absence of the chairman or his having an obstruction, he would be replaced by the deputy chairman who will have the same jurisdiction and powers assigned to the chairman. If the position of the court chairman or deputy chairman or one of the court members becomes vacant as a result of his resignation, demise, health inability or for any other reason, a replacement for him shall be appointed under Royal Ordinance to succeed him for a term of five years renewable once".

    "Article 7: The General Assembly shall be presided over by the court chairman and in the event of his absence or his having any obstruction, the chairmanship shall be assigned to the deputy chairman then to next court member according to their serial order in the Royal Ordinance which appointed them".


    Article 2: A new article shall be added to the Decree-by-Law NO. 27 for the year 2002 regarding the establishing of the Constitutional Court under number 8 ditto according to the following text:

    "Article 8 ditto: The court shall have its own independent annual budget which commences with the beginning of the official financial year and ends by the end thereof.

    The court chairman shall prepare in agreement with the Minister of Finance the bill of the budget before the beginning of the financial year by sufficient time and in preparing the bill of the budget should observe the listing of revenues and expenditures in one figure and submit the proposed budget to the Finance Minister.

    After endorsement of the public budget, the court chairman, in coordination with the Finance Minister, shall distribute the total allocations to the court budget on the basis of the classification stated in the state's public budget.

    The court chairman shall assume the powers assigned to the Finance Minister in laws and regulations pertaining to implementation of the court budget within the confines of the allocations listed therein.

    Also, the court chairman shall assume the powers assigned to the Civil Service Bureau.

    The court shall deposit the excess financial allocations which have not been expended or which have not been complied with during the ending financial year into the state's public budget.

    The court chairman shall prepare the final account for the court's budget on prescribed timing and refers it the Finance Minister who would list it into the final account of the state's public budget.".

    The Act starts with providing a definition of human trafficking, and declares that such acts are illegal and need to be stopped and punished. Penalties include both fines and imprisonment. Also provides for aggravating circumstance and sets out the different penalties for such acts. Provides for the treatment and consideration of the victim including medical, psychological, and housing assistance if needed. A committee for the assessment of the situation of foreign victims of human trafficking is established to deal with the victims and their departure to their country of origin. The Minister of Social Development is to create centers for the victims of human trafficking, as well as to provide housing and treatment for the victims.

    Provides for establishment of Constitutional Court. Divided into 3 parts. Part 1 regulates establishment of Constitutional Court, its formation, and guarantees for its members and their duties. Court is independent and separate judicial authority. Court comprises President and six members who are appointed by Royal Order. Part 2 provides for powers of Court and procedures. Part 3 governs judgments and verdicts. Court's verdicts are final and shall not be challenged.

    Replaces constitution of 1973. Comprises 6 chapters. Chapter 1 (s. 1-3) contains provisions regarding the State. Section 1 defines Kingdom of Bahrain as hereditary constitutional monarchy, but also states that sovereignty is "in the hands of the people, the source of all powers". Section 2 declares Islam the religion of the State and Islamic Shari'a "the principal source for legislation". Chapter 2 (s. 4-16) provides for basic constituents of society. Section 11 states that "all natural wealth and resources are State property". Chapter 3 (s. 17-31) regulates public rights and duties. Section 18 affirms that "people are equal in human dignity, and citizens are equal before the law in public rights and duties". Chapter 4 (s. 32-107) provides for public authorities. Chapter 5 (s. 108-119) deals with financial matters. Chapters 6 and 8 (s. 120-125) contain general and final provisions.

    Substitutes numerous sections of the Labour Law. The law shall not apply to civil servants, domestic workers, seafarers, family and casual workers, and most agricultural workers (section 2). S. 3 prohibits the employment of a non-Bahraini without first obtaining a work permit. Employers shall be liable for the costs of repatriating a foreign worker when a contract expires (s. 7). S. 14 prohibits recruitment and employment agencies from exacting fees from workers. S. 62 provides for rest periods for female employees to nurse their infants for two years following birth. Other substituted provisions regard foreign workers, labour contracts, apprentices, hours of work, overtime, dismissal, annual leave, and penalties for contravention of the Law.

    The new Consultative Council is the first institution of its kind in Bahrain. Its role is to examine - and submit views on - draft legislation, state policy, matters relating to public services, economic development and any other matters referred to it by the Council of Ministers. At the request of at least ten of its members, the Consultative Council may also propose draft legislation or submit petitions. The Council's views are to be set out in the form of recommendations to the Council of Ministers. Its 30 members were appointed by Decree of the Amir on 27 December 1992, for a renewable term of four years; its first meeting was held on 16 January 1993. All meetings are formally called by the Amir.

    The Consultative Council may petition the Government on general matters within its terms of reference. Any proposals to this effect must be signed by at least ten members, accompanied by an explanatory memorandum and submitted to the Chairman of the Council who must first determine whether the proposal is acceptable. "In any event, ... proposals containing unsuitable expressions or anything offensive to the dignity of persons or institutions or prejudicial to the interests of the State shall be rejected". In addition to the submission of such proposals, the Rules of Procedure cover the functions of the Chairman and other officers of the Council, the establishment of specialized committees (legal affairs, foreign affairs, public services, public utilities), consideration of draft legislation, etc.
