    The Regulations prescribe the criteria and methodology for assessing work of equal value contemplated in section 6(4) of the Employment Equity Act which was amended by Act No. 47 of 2013. It sets out the obligations of employers with respect to ensuring that unfair discrimination, including wage discrimination, is eliminated in the workplace with respect to work of equal value including but not limited to eliminating wage discrimination based on race, gender or disability. The regulations define what is meant by work of equal value and also provide factors which may justify differentiation in terms of employment conditions. In order to ensure that the regulations are implemented, there are a number of obligations that employers must comply with including the drafting and implementation of an Employment Equity Plan, as provided for in the Act, as well as reporting obligations to the competent authorities. Enforcement is undertaken through the issuing of written undertakings and compliance orders by the Labour Inspectors or the Director-General Review Process.

    The National Strategic Plan (NSP) 2012-2016 is the country's third master plan that outlines how the country will respond to the prevention and treatment of HIV and AIDS, TB and STIs over the next five years. It seeks to improve on the achievements of the last Plan (NSP 2007-2011), which massively scaled up our anti-retroviral treatment (ART) programme and sought to decrease the number of new HIV infections.

    VISION
    The vision of the National Strategic Plan (NSP) 2012 - 2016 is driven by a long-term vision for the country and subscribes to the universal vision of the United Nations¿ Agency for HIV/AIDS (UNAIDS). Driving this vision is the commitment to have a country and world where in future there will be no new HIV, TB and STI infections, no transmission of HIV and other STIs from a parent to an unborn baby, no deaths caused by HIV, TB and STI infections and no discrimination of anyone based on their HIV, TB or STI infection. The NSP¿s vision is also in line with the mandate of the national Health Department, whose aim is to promote a healthy life, increase life expectancy, decrease maternal and child mortality and to combat HIV and AIDS as well as decrease the burden of disease from TB amongst all South Africans and all those who live in South Africa, including migrant populations.

    GOALS
    In line with UNAIDS's vision, the NSP has the following broad goals:
    - To reduce new HIV infections by, at least, half (50%) using a combination of available and new prevention methods.
    - To ensure that 80% of all people who need antiretroviral treatment (ART) actually do get it, ensure that 70% of these people do recover and remain alive and on treatment five years after initiation of ART.
    - To reduce the number of new TB infections and deaths caused by TB by half (50%).
    - To ensure an enabling and accessible legal framework that protects and promotes human rights in order to support the implementation of the NSP.
    - Lastly, to reduce self-reported stigma related to HIV and TB by 50%.

    OBJECTIVES
    The NSP seeks to fulfil four objectives:
    - To address the social and structural barriers to HIV, STI and TB prevention, care and impact.
    - To prevent new HIV, STI and TB infections.
    - To sustain health and wellness.
    - To promote and to support the protection of human rights and to help improve access to justice.

    MISSION
    While progress has been made and and will continue to be improved - in the treatment of AIDS, TB and STIs, the ultimate mission of the NSP in the next three years is to promote PREVENTION to take centre-stage in the country¿s response to HIV, TB and STIs in South Africa.

    To provide for the issuing of protection orders against harassment; to effect consequential amendments to the Firearms Control Act, 2000; and to provide for matters connected therewith.

    The aim of the Act is to:
    (a) afford victims of harassment an effective remedy against such behaviour; and
    (b) introduce measures which seek to enable the relevant organs of state to give full effect to the provisions of this Act.

    Harassment is defined as:
    "directly or indirectly engaging in conduct that the respondent knows or ought to know-
    (a) causes harm or inspires the reasonable belief that hann may be caused to the complainant or a related person by unreasonably-
    (i) following, watching, pursuing or accosting of the complainant or a related person, or loitering outside of or near the building or place where the complainant or a related person resides, works, carries on business, studies or happens to be;
    (ii) engaging in verbal, electronic or any other communication aimed at the complainant or a related person, by any means, whether or not conversation ensues; or
    (iii) sending, delivering or causing the delivery of letters, telegrams, packages, facsimiles, electronic mail or other objects to the complainant or a related person or leaving them where they will be found by, given to, or brought to the attention of, the complainant or a related person; or
    (b) amounts to sexual harassment of the complainant or a related person."

    Provides for protection against employment discrimination and for affirmative action. Chapter II prohibits discrimination in employment with regard to race, gender, sex, pregnancy, marital status, family responsibility, ethnic or social origin, colour, sexual orientation, age, disability, religion, HIV status, conscience, belief, political opinion, culture, language and birth. Also prohibits harassment based on any of the above grounds, as well as medical and psychological testing of employees, including for HIV status, except in certain circumstances. S. 11 provides that whenever an allegation of discrimination is made, the employer shall prove that no discrimination occured. Chapter III provides for affirmative action. Designated employers shall undertake affirmative action measures such as accomodation and removal of employment barriers for designated groups of employees. Designated employers include the State, employers with more than 50 employees, and employers with more than a specified annual turnover. Designated groups are black people, women, and disabled persons. Designated employers shall also prepare an employment equity plan which outlines affirmative action measures; these reports shall be submitted to the Department of Labour at designated intervals. Chapter IV establishes a Commission for Employment Equity. Chapter V provides for the enforcement of the Act.

Also sets forth guidelines for employers for creating and maintaining a working environment in which the dignity of employees is respected, and in which victims of sexual harassment will not feel that their grievances are ignored or trivialised, or fear reprisals.

    Provides for certain matters relating to the conditions of service of employees of the South African Transport Services (categories of employment, salary adjustments, employment injury compensation, non-discrimination on the basis of colour, race or sex in appointments (s. 3(7)), discipline, etc.). Establishes the Labour Council, the objects of which are to maintain and promote labour peace and prevent labour disputes by means of collective bargaining, referral to mediation, arbitration or other procedure (s. 8). Strikes are prohibited (s. 21). Repeals, inter alia, the Conditions of Employment (South African Transport Services) Act 1983.

    Amends s. 26 of the Conditions of Employment (South African Transport Services) Act 1983 so as to provide for steps which may be taken by the General Manager in case of an illegal strike (including termination of an employee's service) and inserts s. 32A in that Act for the purpose of achieving parity in service conditions for employees of all races. Also amends s. 1 and repeals s. 16 of the Railway and Harbours Pensions for Non-Whites Act 1974 for the purposes of having parity in pension benefits for all races. In addition, amends ss. 4 and 9 of the South African Transport Service Act 1981 regarding other functions.

    Amends the Mines and Works Act 1956 in relation to the regulatory powers of the Minister. In particular, refers to requirements for certification of competency with a view to safety and health at mines or works ("provided that no distinction shall be made on the basis of race or colour" (new s. 12(nA)) and the permissible number of hours or shifts which employees with a view to safety and health may work. Adds a new subsection (2) to section 12 stating that the Minister shall consult with any employees' or employers' organisation which in the Minister's opinion has an interest in the composition of certain committees.

    Exempts from the application of s. 26(1) of the Groups Areas Act (Act 36 of 1966) certain persons, including a bona fide employee (other than a domestic servant) of a person lawfully occupying land or premises while such employee is on duty. Disqualified persons are not permitted on the land or premises between 10 p.m. and 8 a.m. Entry into force on 1 July 1986.
