    The general minimum wage applies to employees and certain interns. The following are not employees within the meaning of the MWA:

    - Anyone who works as a volunteer/in an honorary capacity.
    - Anyone who does voluntary service.
    - Anyone who is enrolled in a measure that actively promotes their participation in the labour market.
    - Anyone who is a home worker under the Home Works Act.
    - Anyone who is self-employed.
    Under section 2 (1) of the Minimum Wage Act, employers must normally pay the minimum wage for each hour worked and pay this by the date specified by law.

Contracted out employees retain their employment relationship with the original employer. There shall be no new labour contract between the employee and the temporary employer. The Act provides protection for contracted out employees against short term employment in times of a surge in the demand for labour and against dismissal in during a fall in the demand for labour.

    Concerns employees working at home. During the first four weeks either the employer or the worker can terminate the contract with one day's advance notice. After that time the period of notice is two weeks, and can extend to as much as three months as the number of years of service increases. The Federal Act regarding protection against unlawful dismissal is not applicable to these contracts. The employer also must inform the employment service of a state when these contracts are concluded.

Division X provides for penalties and Division XI deals with the central trades registry.

    El decreto citado regula el Régimen Jurídico de la Cesión Temporal de Trabajadores, así como la actividad de las empresas de trabajo temporal y sus relaciones contractuales con los trabajadores y usuarios, y deroga el Decreto Presidencial núm. 272/11, de 26 de octubre, y las demás normas que se le opongan. El decreto se estructura de la siguiente manera:
    -Capítulo I: Disposiciones generales
    -Capítulo II: Contratos
    -Capítulo III: Disposiciones finales.

    Decreto núm. 34/03 que fija el salario mínimo nacional.

    Fija el monto del salario mínimo nacional garantizado a los trabajadores en relación de dependencia. Dispone, asimismo, que el salario mínimo nacional se actualiza periódicamente en base a consultas con los interlocutores sociales, teniendo en cuenta la evolución y tendencia del índice general de precios al consumidor, el nivel general de salarios y las prestaciones de seguridad social.

    Decreto núm. 59/91, por el que se establece para los trabajadores de las empresas estatales, privadas, mixtas y conjuntas, una escala de salarios mínimos obligatorios. Revoca los artículos 1 a 4 del decreto 44/89, de 5 de agosto y el artículo 1 del decreto núm. 25/90, de 28 de setiembre.
