Circular No. 11/2013/TT-BLDTBXH promulgating the list of light tasks permitted for persons under 15 years old. -

Employers are responsible for ensuring that children under the age of 15 years that are employed in the enterprise are employed only in light work as set out in the list of light work which is permissible annexed to the Circular. They must also ensure that children have a health certificate before they begin work, that the workplace meets the occupational safety and health standards and that they implement the provisions of the Labour Code concerning children. When employing children for the first time, they must inform the Ministry of Labor, Invalids and Social Affairs of their province or city. Each year they must send a report to the Ministry concerning the employment of children along with the annual OSH report. Also sets out the responsibilities of the Ministry with respect to the employment of children.

According to the Circular, children under the age of 13 years are able to be employed as actors or actresses and athletes. Children between the ages of 13 up to 15 years may be employed in
- traditional jobs, arts and crafts;
- wicker, making home appliances, fine art crafts from natural materials such as: rattan, bamboo, neohouzeaua, coconut, banana, water hyacinth;
- Rearing silkworms; and
- Packing coconut candy.

Article 2 deals with the organization of the implementation of the Program. Children Relief Funds are public non-business units established at central and provincial levels and managed by the Ministry of Labor, War Invalids and Social Affairs (with regard to the National Fund for Vietnamese Children) or provincial-level Services of Labor, War Invalids and Social Affairs (with regard to provincial/ municipal Children Relief Funds) under the Government's Decree No. 186/2007/ND-CP of December 25, 2007, defining the functions, tasks, powers and organizational structure of the Ministry of Labor, War Invalids and Social Affairs, and Decree No. 13/2008/ND-CP of February 4, 2008, stipulating the organization of specialized agencies under provincial/municipal People's Committees.

Persons entitled to supports from Children Relief Funds:
- Children in exceptionally difficult circumstances, including orphans without anyone to rely on: abandoned children: disabled children; children victims of toxic chemicals; HIV/AIDS- infected children: children doing heavy or dangerous jobs or exposed to hazardous substances; children working far away from their families; street children; sexually abused children; juvenile drug addicts, and juvenile law offenders;
- Children infected with serious or dangerous diseases requiring high treatment costs; injured children;
- Children in mountainous, deep-lying or remote regions, former revolutionary bases, and natural disaster- or epidemic-hit areas:
- Children of poor families who surmount difficulties and record good academic achievements at schools;
- Children specifically designated by donors;
- Other children in accordance with the funds' principles and purposes.

Replaces the Finance Ministry's Circular No. 112/2004/TT-BTC of November 24, 2004, guiding the management and use of the National Fund for Vietnamese Children.

Provides that the State is responsible for adopting policies to create conditions for youths, inter alia, to study and work (Art. 4.2). The State is also to manage youth employment by implementing policies, strategies and programs, through training, inspection of violations and complaints (Art. 5). Art. 7 provides for international cooperation on youth employment. Art. 10 sets out the rights and obligations of youths with respect to employment. Art. 18 sets out the responsibilities for the State, family and society with respect to youth employment. Art. 31 states that the State is to implement the UN Convention on the Rights of the Child, which is ratified by Vietnam.

Ratifies the 2004-2010 Program on prevention of, and solution to, the situation of street children, sexually abused children and children subjected to heavy labor or working under noxious and hazardous conditions. The Overall objectives of the Program are to raise the awareness and promote actions of the entire society for the work of child protection; to prevent, gradually reduce and proceed to substantially reduce by the year 2010 the number of street children, sexually abused children and children subjected to heavy labor or working under noxious and hazardous conditions, and create conditions for those children to be protected, cared for, educated and to develop and enjoy an ever better life.
2. Specific objectives:
- To prevent the delinquency situation of children and support street children, with a view to reducing by 90% the number of those children by the year 2010, of whom 70% shall be rendered support to integrate themselves with their families.
- To prevent, gradually reduce and proceed to substantially reduce by the year 2010 the number of sexually abused children.
- To prevent and solve the situation that children have to do heavy jobs or work under noxious and hazardous conditions in order to reduce by 90% of the number of those children by the year 2010.
- To raise the managerial capability of officials engaged in child protection work, specially those of the ministries, branches and People¿s Committees of all levels in charge of protecting and caring for children in special circumstances.
