Reglamento núm. 8914, de 6 de julio de 2017, para la inscripción de patronos y el aseguramiento contributivo de las trabajadoras domésticas -

El citado reglamento contiene las disposiciones generales para que todo patrono físico que emplea una o más trabajadoras domésticas, cumpla con su obligación de incluirlas como trabajadoras asalariadas en los seguros administrados por la Caja Costarricense de Seguro Social (CCSS). Impone a todo patrono que contrate una trabajadora doméstica la obligación de reportar mensualmente, en las planillas de la CCSS, la totalidad del salario devengado por su trabajadora, incluidos los salarios ordinarios, extraordinarios y los equivalentes al salario en especie, cuando así corresponda. Determina las contribuciones al Seguro de Salud y al Seguro de Invalidez, Vejez y Muerte y crea la Escala de Bases Mínimas Contributivas Reducidas. Establece el plazo para gestionar el acto de inscripción o reanudación patronal y los requisitos que deberá cumplir el patrón físico.

The purpose of the Regulations is to protect the rights of domestic workers and set out the regulations for the relationship between domestic workers and employers. This includes, inter alia, the obligation to enter into a written contract and define wages, working time, leave, the role of the worker and training which will be provided by the employer. It also includes a clause providing that "an employer of a domestic worker shall, in accordance with section 116 of the Act, ensure that the domestic worker is not subjected to any form of forced labour".

Domestic workers are to be issued a Passbook which includes details of the employment contract, salary etc. Provides that all employment agreements between Agencies and domestic workers are to be in writing. The Delhi Commission for Women and the Child Welfare Committee is to receive information from the Department of Labour and is to supervise the implementation of the above provisions. The Order also includes penalties in case of non-compliance with the Order.

Regulates the private offices of recruiting Non-Jordanian Domestic Workers.
Requires employers to purchase insurance from any legally licensed company that will cover the householder (employer) for financial losses resulting from the worker leaving or ‘refusing to work’. In addition, recruiters are bound to replace domestic workers for employers in three circumstances. Firstly, recruiters must replace those who ‘refuse to work’ for their new employer during the first 30 days at no further cost to the householder and on condition that the original recruit is ‘transferred outside of the country’. Secondly, where a migrant worker fails to arrive in Jordan whether by choice or not, recruiters must provide their employer with a replacement domestic worker at no additional cost. Thirdly, the responsible recruiter must also replace a domestic worker if the employer finds her to be pregnant or are otherwise certified as unfit by the Ministry of Health. However, recruiters are not legally responsible for replacing a domestic worker if employers have caused her to leave their employment, such as in cases where they have assaulted the worker.

The above Order applies to employees employed in private households, engaged in domestic duties, such as servants, maids, housekeepers, cooks, butlers, valets, handymen, cleaners, charwomen, washerwomen, baby-sitters, nursemaids, and other persons employed in related work, including chauffeurs, gardeners and similar occupations connected with the household. "Private households" includes charitable institutions, monasteries and convents but does not include any hospital, clinic, nursing home, institute of medico-surgical treatment, maternity home or hydropathic establishment, home for aged persons or schools run by any such households.
Contains provisions on the employment and working conditions for domestic workers including hours of work, remuneration, meals, minimum daily and weekly rest, vacations, leave and retirement.

Est promulguée par le Dahir n° 1-16-121 du 10 août 2016.

El decreto citado aprueba el Convenio 189 sobre el Trabajo Decente para las Trabajadoras y los Trabajadores Domésticos, adoptado por la Organización Internacional del Trabajo (OIT) en Ginebra, Suiza, el 16 de junio de 2011.

Decreto núm. 40/2008 por el que se aprueba el Reglamento del Trabajo Doméstico. (Decreto n.° 40/2008: Aprova o Regulamento do Trabalho Doméstico.) -

Regula las relaciones laborales emergentes del contrato de trabajo doméstico. Se aplica a los empleados que prestan trabajo doméstico a un agregado familiar o equivalente.
Contempla en detalle todo lo referido al contrato de trabajo doméstico: cláusulas contractuales, derechos y deberes de las partes, disicplina del trabajo, duración de la prestación de trabajo, interrupción de la prestación de trabajo, remuneración y suspensión y cesación del contrato de trabajo. Regula también la fiscalización.
El Anexo I incluye un modelo de contrato de trabajo.
