Federal Act of 25 November 1987 amending the Construction Workers' Leave Act [BGBl. 414/1972], the Workers' Termination Act [BGBl. 107/1979] and the Insolvency (Wage Guarantee) Act [LS 1977 - Aus. 1]. Text No. 618. Adopción: 1987-11-25 | AUT-1987-L-4484 This Act changes the title of the 1972 Act to the Construction Workers' Leave and Termination Act. It introduces a new Division III, entitled Conditions of Termination (ss. 13a-13h), which governs rights to severance pay in various cases. The amount of severance pay ranges from two months' wages for a worker who has completed 156 weeks of employment to twelve months' wages for a worker having worked over 1300 weeks (s. 13d). The Act also amends sections dealing with administration of the Leave and Severance Pay Fund and its financing and makes miscellaneous conforming amendments. A new subsection (3) is added to s. 2 of the Workers' Termination Act of 1979 in regard to calculating continuous service. The Insolvency (Wage Guarantee) Act is amended to provide, inter alia, that employers are to pay a supplement; when it has been paid, no claim to severance pay can be made in case of insolvency (amendment of s. 12(1)(Z) and addition of subs. Z5 to s. 1(3)). With the exceptions detailed in Part V of this Act, the amendments entered into force 1 Oct. 1987.

The amendments address the role of the works council in relation to redundancies and dismissals and its review of financial information (ss. 56a, 58(2), 63(3), (4) and (5) and 64). They deal in particular with periods of notice for calling meetings, use of the sex-neutral title "president" instead of "chairman" and judicial resolution of disputes (s. 33(7) of the Order). A new Division 8, entitled "Representation of Young Persons in the Enterprise", is inserted after s. 50.

Calculation of Severance Payments (Maximum Basic Pay) Order. No. 64. Adopción: 1991-11-27 | BRB-1991-R-26740 This Order under s.3 of the Severance Payments Act (Cap. 355A) and under par.6(2) of the First Schedule to the Act provides that the amount of a week's basic pay shall not be taken to exceed the sum of 715 dollars or the sum prescribed in the Severance Fund Contribution Regulations, 1977, as the maximum insurable earnings of a person paid weekly. The Order also revokes the Calculation of Severance Payments (Maximum Basic Pay) Order, 1984, subject to sub-paragraph (2). The Calculation of Severance Payments (Maximum Basic Pay) Order, 1984 continues to apply in respect of any employee dismissed before the commencement of the Order.
