La ley citada tiene por objeto la prevención, persecución y sanción de la trata y la explotación de personas, así como la atención, protección y reparación de las víctimas. Por otra parte, modifica el artículo 280 del Código Penal, relativo a la reducción de personas a la esclavitud, servidumbre o trabajo forzoso, y agrega los artículos 280 bis (Esclavitud sexual), 280 ter (Unión matrimonial o concubinaria forzada o servil), 280 quater (Prostitución forzada) y 280 quinquies (Apropiación de niñas, niños o adolescentes para la adopción). La ley se estructura de la siguiente manera:

Se modifica el artículo 149 del título III "Delitos contra la paz pública" del Código Penal: por una parte, se eliminan ciertas referencias del primer párrafo, quedando tipificado exclusivamente el delito de instigación pública a desobedecer las leyes, el cual conlleva pena de multa. Por otra parte, se agregan dos disposiciones: el artículo 149bis, por el que se sanciona con prisión la incitación al odio, desprecio o violencia basada en motivos de raza, color, religión u origen nacional o étnico. El artículo 149ter, por el que se aplica la pena de prisión en caso de comisión de actos de odio, desprecio o violencia basados en idénticos motivos.

Así, modifica lo relativo a su objeto y finalidad, y sus principios, enfoques, derechos protegidos y garantías. Además, modifica lo relativo a las medidas de seguridad y protección y las medidas cautelares, la prohibición de mediación y conciliación, la competencia, las formas de violencia y el carácter vinculante de las políticas públicas en la materia. Asimismo, crea la Comisión Nacional para Garantizar el Derecho de las Mujeres a una Vida Libre de Violencia, estableciendo sus principios, atribuciones y composición. También modifica lo relativo a las penas por los delitos de violencia sexual, acto sexual con víctima especialmente vulnerable, abuso sexual sin penetración, prostitución forzada, esclavitud sexual, acoso sexual, violencia patrimonial o económica, violencia política, violencia obstétrica, esterilización forzada, violencia informática, ofensa pública por razones de género, violencia institucional, tráfico y trata de mujeres, niñas y adolescente y femicidio.

An Act to provide for a transparent legal framework for the protection of, access to, and use of, traditional knowledge, genetic resources and expressions of folklore, which also guarantees equitable sharing of benefits and effective participation of holders; to recognise the spiritual, cultural, social, political and economic value of traditional knowledge, genetic resources and expressions of folklore of holders; to promote the preservation, wider application and development of traditional knowledge, genetic resources and expressions of folklore; recognise, protect and support the inalienable rights of traditional communities, individuals and groups over their traditional knowledge, genetic resources and expressions of folklore; to confer rights on traditional communities, individuals and groups and promote the conservation and sustainable utilisation of the country’s biodiversity resources; to promote fair and equitable distribution of the benefits derived from the exploitation of traditional knowledge, genetic resources and expressions of folklore; to promote the use of traditional knowledge, genetic resources and expressions of folklore for the benefit of traditional communities, the country and mankind in general; to ensure that exploitation of traditional knowledge, genetic resources and expressions of folklore takes place with the prior informed consent of a traditional community, individual or group; to prevent the granting of patents based on traditional knowledge, genetic resources and expressions of folklore without the prior informed consent of a traditional community, individual or group; give effect to the African Regional Intellectual Property Organisation (ARIPO) Swakopmund Protocol on the Protection of Traditional Knowledge and Expressions of Folklore, 2010, the World Trade Organisation Trade-Related Intellectual Property Rights Agreement (TRIPS), 1994 and any other relevant international treaty or convention to which Zambia is a State Party; and to provide for matters incidental to, or connected with, the foregoing.
