Decreto núm. 6207, de 28 de diciembre de 2015, que prohíbe los despidos sin causa justificada por un lapso de tres (3) años - Adopción: 2015-12-28 | Fecha de entrada en vigor: 2015-12-28 | VEN-2015-R-103829 El citado decreto ordena la inamovilidad de los trabajadores y trabajadoras por un lapso de tres (3) años contados a partir de su entrada en vigencia, prohibiendo los despidos, traslados o desmejoras sin causa justificada y con apego a los procedimientos establecidos en la legislación laboral. Enumera los trabajadores comprendidos y aquellos exceptuados. Prevé, en caso de incumplimiento, el derecho del trabajador o trabajadora a ejercer las acciones a que haya lugar para su reenganche, así como el pago de los salarios y demás beneficios dejados de percibir, cuando corresponda. Asimismo, establece las sanciones aplicables al patrono o patrona que despida, traslade o desmejore a un trabajador o trabajadora amparado por sus disposiciones.

Labour Code (No. 45/2019/QH14). (Bô luât Lao Dông) - Adopción: 2019-11-20 | Fecha de entrada en vigor: 2021-01-01 | VNM-2019-L-110469 The 2019 Labor Code revokes the 2012 Labor Code. The 2019 Labor Code expands the scope of application to "workers without labour relations" defined as workers who work without an employment contract. It also broadens the definition of Employee to "a person who works for an employee under an agreement, is paid, managed and supervised by the employer."
The Code also modifies the type and content of labour contracts and provides more bases for both employers and employees to unilaterally terminate labour contracts. The main changes are the following:
- WAGES, HOLIDAYS & HOURS OF WORK: The monthly overtime cap is increased from 30 to 40 hours. There is to be an additional national holiday implemented. Concerning wages, employers are still required to set up salary schemes and consult with employee representative organisations. However, the schemes no longer require registration and notification with the labour authorities.
- TERMINATION OF EMPLOYMENT: The Code recognises sexual harassment at the workplace as an additional ground for dismissal.
- MIGRANT WORKERS: For foreign workers, the new Labour Code limits the term of work permits to a maximum of two years, which may be extended for a further two years. However, after this, migrant workers will need to apply for a new work permit.
- RETIREMENT: Retirement age is to be increased to 60 years for female workers and 62 for males. Exemptions apply for workers working in hazardous conditions.
- FREEDOM OF ASSOCIATION: The Code recognises the right of employees to set up their own representative organisations.

The Code shall apply to all workers except public servants, foreigners, casual workers, and domestic servants. Work is the natural right and duty of every citizen on the basis of equal conditions and opportunities without discrimination on the grounds of sex, age, race, colour, beliefs or language (Art. 5). Art. 11 establishes a Labour Council with the function of drafting labour law and policies and administering vocational training. Employers shall engage disabled persons up to a proportion of 5 per cent of their workforce (Art. 15). Non-Yemenis shall constitute no more than 10 per cent of any employer's workforce. Chapter II regulates contracts of employment, including collective agreements. Collective agreements which "damage the economic interests of the country" shall be invalid (Art. 32). Chapter IV covers employment of women and young persons. Women shall be equal with men in relation to conditions of employment and employment rights (Art. 42). Chapter V covers wages and allowances, including minimum wage and overtime; Chapter VI concerns hours of work. Chapter VII relates to work discipline and penalties; Chapter VIII to vocational training, including apprenticeships; Chapter IX to occupational safety and health; Chapter X to health insurance; and Chapter XI to labour inspection. Chapter XII covers labour disputes and strikes. Labour disputes which cannot be settled amicably must be submitted to an Arbitration Committee for resolution. Should arbitration fail, workers may proceed to a strike under specified conditions. Inter alia, individual workers must announce their intention to participate in a strike by wearing a red arm-band for three consecutive days before the commencement of the strike (Art. 146). Chapter XIII covers workers' and employers' organizations, and provides freedom of association.

It also substitutes new text into sections 19 and 83 and inserts new sections 82B (administration of Part XI), 90A (procedure and evidence in the Labour Court), and 92D (appeals to the Labour Court no provided for elsewhere in this Act).
