    The reason for the promulgation of these Ministerial Regulations are as follows: Since the Ministerial Regulation B.E. 2541 (1998) issued under the Labour Protection Act B.E. 2541 (1998) prescribing therein that part of the Labour Protection Act B.E. 2541 (1998) shall not be applied to an employer whose employee is engaged in domestic work without any involvement in business operation; therefore the protection provided to an employee engaged in domestic work without any involvement in business operation does not respond to the changed social and economic conditions. It is reasonably to extend the protection provided to the employee engaged in domestic work for more coverage. Accordingly, this Ministerial Regulation shall be issued.

    Sets out the minimum wage as set by the Wage Committee which is a tripartite body consisting of five representatives each of employers, employees and the government in accordance with the Labour Protection Act.

    Repeals articles 3 to 31 of the Notification by the Wage Committee on Minimum Wage Rate (No. 6) dated 2 November B.E. 2554.

    Royal Amnesty Decree, B.E. 2555.

    The Royal Decree was adopted to provide Royal Pardons to convicts serving imprisonment terms so that they may have a chance to reform themselves and become good citizens.

    Section 1. provides the official title of the Decree
    Section 2. provides that it will come into force from the day following the date of its publication in the Government Gazette
    Section 3. Definitions
    Section 4. Eligibility criteria for pardon.
    Section 5. Lists the convicts that shall be granted a Royal Amnesty and released.
    (1) Detainees,
    (2) Persons performing social service work and public interest work in lieu of a fine,
    (3) Persons being released from correctional custody.
    Section 6. Lists the imprisoned convicts that shall be pardoned under the Royal Amnesty and released subjects to sections 8, 9, 10, 11 and 12
    (1) the following prisoners subject to the conditions set out in the Decree:
    (a) prisoners with less than one year remaining of their prisons sentence,
    (b) prisoners who are disabled or have an illness as outlined in the Decree,
    (c) women prisoners who have been imprisoned for the first time who has served at least half of her sentence,
    (d) prisoners over the age of 60 years old if they have less than three years to serve and all prisoners 70 years and older,
    (e) prisoners under the age of 20 years who has served at least half of their sentence,
    (f) prisoners who have a good record
    Section 7, 8, 9, 10, 11, 12 and 13. establishes the grounds for reduction of sentences.
    Section 14. provides that prisoners sentenced to death will have their sentence reduced to life imprisonment.
    Section 15 and 16. deals with the procedures to implement the Decree.
    Section 17 provides that the Prime Minister, Supreme Court President, Defence Minister, Interior Minister and Justice Minister shall have charge and control over the implementation of the Decree.

    Royal Decree on the Extension on the Period of Time on the Applications of Section 7 of the Act amending Criminal Procedure Code, (No. 21), B.E. 2542, B.E. 2555.

    The period of time on the application of Section 7 of the Act Amending the Criminal Procedure Code (No. 21), B.E. 2542, shall be extended until 31 December 2017. The Act was adopted in order to provide more time to medical doctors to assign hospital officers or officers under Provincial Health Offices receiving training on Forensic Medicine, to participate in the initial post mortem inquest on their behalf due to the lack of medical doctors, in particular forensic medical doctors.

    Act Amending the Law for the Organization of Courts of Justice (No. 4), B.E. 2555.

    Repeals and replaces section 13 of the Law for the Organization of Courts of Justice. It now reads:
    "There shall be one Chief Judge of Region for each Region in number nine Regions with the locations and jurisdictions as prescribed by Courts of Justice Administrative Committee by publishing in the Government Gazette and three Deputy Chief Judge of Region for each Region. In the case where it is necessary for the official interests, the Courts of Justice Administrative Committee with the approval of the Supreme Court President, may designate more than three Deputy Chief Judges of Region, but not exceeding six persons.
    Upon a vacancy of the Chief Judge of Region or the person holding such a position cannot perform his official duty, the most senior Deputy Chief Judge of Region shall assume the duty on his behalf. If the most senior Deputy Chief Judge of Region cannot perform his duty, the senior Deputy chief Judge of Region in respective sequence order down the line shall assume the post to perform such duty.
    In the case where there is nobody to perform the duty in the place of the persons under paragraph 2 above, the Supreme Court President may issue an order to entrust a Judge to perform the duty in their place.
    A senior Judge or a Judge attached to the Court shall not be eligible to perform the duty in place of the post under paragraph one above."
    It also amends articles 14(2), 28(3) and 29(3).

    Amends the Nationality Act B.E. 2508 by inserting a new definition concerning 'Displaced Thai Persons' in between the definitions of 'Alien' and 'Committee' in section 4. New sections 9/1, 9/2, 9/3, 9/4, 9/5, 9/6 and 9/7 are also inserted into the Act. The reason for promulgating the Act are to solve problems relating to the nationality of displaced Thai persons due to the change in the territorial boundary of Thailand.

    Replaces section 148 with "Any employer violating Section 31 or Section 44 shall be subject to imprisonment of no longer than one year or fine of no greater than two hundred thousand baht or both."

    Section 151(2) of the Labour Protection Act as amended by the Labour Protection Act (No. 2) B.E. 2551 is to be repealed and replaced with: "Any person failing to comply with the order of the Labour Welfare Committee as issued under Section 120 or the order of labour inspection officers as issued under Section 124 shall be subject to imprisonment of no longer than one year or fine of no greater than twenty thousand bhat or both."

    Section 154 and 155 are repealed.

'Employer' means a business operator who agrees to employ a homeworker, regardless of whether the assignment of the job will be made through him, his representative or by a sub-contract.

    Also repeals and replaces Clause 3(2) with the following:
    "In the case where a factory business operator desires to pay an annual fee through a commercial bank, post office, or payment service center that connects the computer signal system with computer network system of the Department of Industrial Works, Provincial Industrial Office or Local Administrative Organization, as the case may be, shall proceed ahead with the payment of such annual fee at such place in accordance with the rules and the formal prescribed by the Department of industrial Works Director-General".

    Amends the Provident Fund Act, B.E. 2530 [1987].
    Provides for the regulation of the Provident Fund, the establishment and management of the fund, its assets. Amends section 3 with respect to some definitions; section 5 concerning the establishment of the fund; section 7/1 concerning the assets to be in the fund; section 9(8) concerning payment when an employee's membership to the fund expires; section 9(10) concerning requirements relating to a general meeting. Adds new sections 16 and 17 on investments and recording of revenues. Section 23 is also amended concerning payments out of the fund; section 23/1, 23/2, and 23/3 are also added; sections 24 and 35 are also amended

    Repeals the Act on Rehabilitation of Disabled Persons' Efficiency (B.E. 2534). Establishes the National Commission for the Promotion and Development of Disabled Persons' Life Quality and sets out its compositions, functions and powers. Also establishes an Office to implement recommendations of the Commission. Also establishes a fund to be managed by the Office for the rehabilitation of disabled persons. The appropriate Ministries are to make regulations concerning improving access to buildings and facilities. Provides tax benefits to employers employing a certain number of disabled persons.

    Section 3 - the definition of labour union is repealed and replaced and the new definition reads: "labour union" measn labour organization established according to the law concerning Labour Relations or concerning State Enterprise Labour Relations. Also makes various amendments to other parts of the Act.

    Repeals the Statistic Act B.E. 2508. Makes provisions for the authority responsible for statistics (the National Statistical Office) as well as the collection of data through work units and penalties for not filling out data or providing false information.

    Amends the Trade Association Act B.E. 2509 by repealing and replacing sections 7, 10, 22(1), 30(2), 35 and 36. Also revokes sections 14 and 43. Adds a new section 54/1 concerning penalties where only a fine is imposed.

    Amends the 1966 Act with respect to definition of chamber of commerce, state enterprises and cooperatives as well as repealing and replacing sections 7, 10, 14, 20-23, 24(4), 25, 28(1) and (2), 29(1), (3) and (9), 37(2), 42, and 43(4). A new paragraph (2) is added to section 26 with respect to the director of a chamber of commerce who leaves before the expiration of his/her term. A new provision is to be added as section 60/1 of the Act with respect to fines.

    Sets out the right of rescuers to claim compensation to incite persons to save endangered ships and property at sea and minimise environmental damage. Includes rights and duties of rescuers.

    Ministerial Regulation No. 19 (B.E. 2550), issued under the Factory Act (B.E. 2535).

    Adoption: 2007-06-28 | THA-2007-R-77395

    Repeals clause 6(11) of Ministerial Regulation No. 2 (B.E. 2535) issued under the Factory Act. Replaces clause 7 of Regulation No. 2 with the following text:
    "In the case where there is a reasonable cause, the Minister may specify safety criteria and test methods for machinery, equipments or items used in the factory under Clause 6(2), (3), (7), (9), or (10)."
