A new subsection is inserted after section 38(1) concerning information to be provided by airlines and travel agencies. Section 44 is repealed. A new section is inserted after section 46 concerning the prevention of discrimination and prohibition of harassment. A new section 50 replaces the old on concerning transfer of business undertakings. Section 54, 57, 60(2), 61(2)(iii), 62A(2) and 68 are modified. A new section 72A is inserted concerning a tripartite consultative body. Sections 76(1), 77(2) are amended. Schedule I (all words after heading "C. Redundancy of worker under section 51" replaced) and Schedule II (new Part IIA inserted) are also amended.

    Amends the Employment Act 1995. Inter alia, requires employers to notify the Employment Services Bureau of vacancies in their enterprise, and prohibits the employment of Seychellois without job cards. A new section 50 provides that where there is a change of ownership in a business, the employer shall be deemed to have terminated the employment contract of a worker. Such termination shall not be considered as attributal to the worker, who shall receive any due compensation. Further amendments provide for drug testing (s. 53A) and compensation to workers upon resignation or retirement.

    Provides for the creation of a Consumer Protection Board and the post of a Director of Consumer Protection, both which shall promote consumer education and information, formulate relevant legislation, create means of consumer arbitration, and investigate cases of offences. Section 8 prohibits false advertisement; s. 11 requires producers of goods to ensure reasonable standards of quality and warn consumers of possible risk or hazards associated with a product's use.

Inter alia, employers shall give one month's notice before termination of an employee's contract. Non-Seychellois workers are subject to the same regulations as Seychellois. Provides for the establishment of an Employment Council with the function of monitoring the enforcement of these Regulations. Made under the International Trade Zone Act, 1995.

    Regulates hours of work, overtime, paid leave, sick leave, and rest periods for persons employed in International Trade Zones. Maximum working hours is set at 60 hours a week, or 12 hours a day. Hours worked above this limit shall be paid overtime wage. Prohibits night work or overtime work for women who are more than 6 months pregnant; after 3 months of pregnancy, women shall have the right to be transferred to other work assignments should a physician declare that their present duties pose a hazard to their health.

    Occupational Safety and Health (Workplace Health, Safety and Welfare) Regulations, 1997.

    Applies to all worksites, including temporary workplaces. Provides for maintenance, safety, and cleanliness of workplaces and for specific regulations regarding lighting, ventilation, and working space. S. 9 sets forth maximum exposure limits to ionising radiation, and provides for the removal of workers from sources of radiation and for subsequent medical supervision if employees are exposed to radiation over the set limits. S. 21 provides for medical supervision at worksites where hazardous materials are used. Employers are required to provide fist aid materials and devise emergency evacuation plans at workplaces with 25 or more employees. Also provides for noise protection and protective clothing. Repeals the Occupational Safety and Health (Health and Welfare) and (Miscellaneous) Regulations, 1991.

    Establishes an Economic Development Board for the purpose of approving investors and granting concessions and incentives to potential investors. Investors shall invest no less than 10,000,000 U.S. dollars (s. 5). Concessions and incentives which the Board may grant include immunity from prosecution for all criminal proceedings whatsoever, except those arising from acts of violence or drug trafficking in Seychelles (s. 7). Furthermore, no bill seeking to amend or repeal this Act shall be presented to the National Assembly unless approved of by a referendum with not less than sixty per cent of the vote. Such a bill shall not be passed by the National Assembly unless two-thirds of its members are present and voting at all stages of the approval process.
