Provides for sickness benefits, rehabilitation benefits, compensatory benefits, postnatal allowances, maternity benefits and nursing benefits. Cash benefits for occupational accidents and disease are covered by a separate act. Repeals Act of 17 December 1974 on social security cash benefits in case of sickness or maternity.

Defines occupational pension schemes as being collective agreements concluded within the enterprise between employers and workers or with external institutions such as insurance companies or investment funds for which workers apply. Also regulates conditions of collecting and managing contributions as well as conditions of payment of benefits.

    Confers the power to deliver decisions regarding work disability upon the Social Insurances Institution. Decisions regarding work disability are to be delivered by an expert medical doctor within the Social Insurances Institution after an individual medical examination and upon available medical data regarding the worker applying for work disability benefits. The procedure whereby such decisions are delivered shall be supervised by the Head medical doctor of the Institution on behalf of the Chairman of the said Institution.

    Provides that any decision as to the granting of social welfare benefits, except for social pension, requires a family environment assessment which aims at assessing the personal and material (property) situation of the applying family as well as the reasons for application. Such assessment shall be carried out by a social worker bearing a social worker card at the place of residence of the applying family. Information so collected shall be held secret. Specifies a series of documents required in order to apply.

    Order No. 376 of 3 June 1997 of the Council of Ministers on specific conditions of determining basic scales of social insurance benefits in case of sickness and maternity to which certain groups of insured persons are entitled.

    Defines groups of persons insured by the social security scheme entitled to social insurance benefits in case of sickness and maternity. Such groups include persons working on the basis of agency or mandate contracts as well as members of agricultural production cooperatives and their relatives. The basic scale of social insurance benefit shall consist of the average monthly income calculated on a period of 12 months during which the person concerned was insured prior to the month in which entitlement to social insurance benefits becomes effective, or, for a shorter period, on the actual period of time in which the person was insured.

    Defines types of social assistance centers as well as rules of functioning of such centers. Sets minimum standards regarding basic services to be provided by social assistance centers as well as security standards. Establishes bodies to control such standards as well as control mechanisms. Also defines conditions for issuance and withdrawal of permits to create and manage such centers. Fixes conditions under which persons applying for a place in social assistance centers are to be directed to such centers when these are managed by local State administration or local self-government authorities.

    Order No. 278 of 23 April 1997 of the Minister of Labour and Social Policy on specific conditions of determining fees for accommodation in social assistance centers and waiving such fees, on conditions of charging such fees as well as on conditions of determining of accommodation costs in social assistance centers.

    Provides that fees for accommodation in social assistance centers be charged in proportion to the income of the applying person or its relatives or its legal representatives. Under given conditions accommodation fees can be partially or totally waived, in particular when persons concerned pay fees of their relatives for accommodation in social assistance centers or other institutions of social supports or assistance, when persons concerned suffer from chronic diseases, are unemployed, disabled, pregnant or raise children alone, or when other circumstances justifying a waiver occur. Fees charged shall be deducted directly from retirement benefits or social benefits of the person concerned. In some cases fees paid can be reimbursed. The monthly accommodation fees in social assistance centers shall be determined by the local chief representative of the State administration (voivod) on proposal by the managing board of the social assistance center.

    Order No. 256 of 8 April 1997 of the Council of Ministers concerning the appointment of the government representative for the introduction of the national health insurance.

    Establishes the office of the governement representative for the introduction of the national insurance scheme. The office shall be part of the Ministry of Health and Social Welfare and supervised by the Prime Minister. The representative shall be in charge of implementing measures as stated in the Act of 6 February 1997 on national health insurance, initiating and coordinating works related to drafting of regulations to implement the Act on the national health insurance, analysing and assessing the legal, organizational and economic solutions in the field of health insurance, as well as taking other steps toward effective functionning of health insurance. The representative shall submit assessments of and yearly reports on his activity to the Prime Minister. Expenses in relation with the office of the government representative shall be paid from the State budget.

    Order No. 159 of 25 March 1997 of the Council of Ministers on conditions of early retirement of workers released for reasons in connection with the enterprise.

    Provides a minimum age limit for workers being released in the framework of early retirement for reasons in connection with the enterprise. These limits are: 35 years of age for women and 40 years of age for men.

    Order No. 140 of 10 March 1997 of the Minister of Labour and Social Policy on specific conditions and procedures for allocating periodical benefits.

    Defines the periodical benefit as being a cash benefit paid monthly for a period not exceeding one month after reasons for its payment have ceased to exist. It can be allocated to concerned persons or their relatives on grounds of a long lasting sickness. The periodical benefit is meant to cover a special per diem, medicine, medical treatment, etc. Also sets specific conditions under which the periodical benefit can be granted.

    Introduces a national health insurance. Benefits cover sickness, pregnancy, maternity, measures preventing sickness as well as assessment of health condition. Benefits shall be granted to persons subject to insurance obligation and their relatives. Persons insured shall be of Polish citizenship and living whithin the territory of the Republic of Poland, or of foreign citizenship and living within the territory of the Republic of Poland, having registered as persons subject to insurance obligation and having paid their contributions. Establishes national health insurance offices, on the national and regional level, to perform tasks within the scope of the national health insurance, and defines their organization. Sets rules and procedures for allocating health insurance benefits and providing related services.

    Order No. 51 of 4 February 1997 of the Council of Ministers on the government representative for the reform of the social security.

    Establishes the office of the government representative for the reform of the social security system. The representative shall be the Under-Secretary of State whithin the Office of the President of the Council of Ministers. His duties shall include, inter alia, the setting-up of the agenda of the preparation works for the reform of the social security system and initiating and co-ordinating of works on the reform-related draft legislation. The representative shall submit such drafts to the Council of Ministers for assessment in consultation with the Minister of Labour and Social Policy. The representative shall submit to the Council of Ministers assessments, expert opinions, proposals and yearly reports within his field of competence and expertise. Expenses connected to the work of the representative shall be financed from the State budget.

    Extends the application of Article 92 of the Labour Code to home workers. During the first 35 days of sickness, home workers shall be entitled to cash sickness benefits, payable from the employer's financial means.

    Registration and identification of unemployed persons shall be carried out by regional labour offices under the National Labour Office. Registration confers on the unemployed the right to unemployment benefits and job offers.
