    Bonded Labour (Prohibition) Act, 2002 (Act No. 21). - Laws on-line in English

    Prohibits labour or services provided by a person to his creditor without any wages or at low rates of wages to repay loans (Kamaiya labour). All persons working as Kamaiya labourers at the time of the commencement of the Act are ipso facto freed from that labour (art. 3). Loans do not have to be repaid (art. 5). The Act establishes Freed Kamaiya Rehabilitation and Monitoring Committee in districts prescribed by HMG and sets out their functions. In addition, Welfare Officers are to be designated to assist freed Kamiaya labourers (arts. 10-11). The HMG shall have the power to fix minimum wages for agricultural labourers (art. 13). Chapter 6 sets out the complaints, penalties and appeals.

    Provides for formation and mobilisation of an armed police force. Chapter II deals with supervision, control, direction and administration of armed police force. Chapter III sets forth provisions concerning appointment, transfer, promotion, qualifications needed for candidacy, swearing-in, punishment and appeal, suspension, and immunity from arbitrary dismissal. Chapter 4 regulates duties and powers of armed police. Chapter 5 deals with different crimes and punishments. Finally, Chapter 6 provides for armed police special courts and appeals.

    Made under the Public Security Act 1989. Establishes that in case local authorities receive information that a person or group is about to commit an act listed under Section 3 of these Rules, this shall be regarded as a reasonable ground to believe that the sovereignty, integrity and public tranquillity of Nepal may be harmed immediately. Also provides for issuing of detention orders, submission of petitions by persons feeling aggrieved by such orders, and for power to revise and invalidate orders.

    Amends personal baggage order 1999 to make provision for arrangments relating to personal baggage in respect of customs duty and concessions on goods brought or carried by any traveller as accompanied baggage, or brought or sent by him as unaccompanied baggage before or after his arrival or departure.

    Regulates employment of children who have not completed 16 years of age. Employment of children who have not completed 14 years of age is prohibited. Makes provision for information to be furnished with regard to employment of children; approval to be obtained; certificates of eligibility to be obtained; hours of employment; remuneration and facilities; health and safety of children; dispute concerning age; register, inspections and removal from employment; penalties and appeals, as well as some related matters. Contains a list of hazardous work that is prohibited to employ children for.

    Amends the Trade Union Act 1992. Extends the Act to workers in establishments, businesses, services outside of establishments, self-employed persons, and agricultural workers. Also amends provisions regarding the functions of trade unions, trade union associations, trade union federations, and registration and amalgamation of trade unions.

    Comprehensive legislation on local self-governance. Divided into 5 parts. Part 2 contains provisions relating to village development, Part 3 provisions relating to Municipality, Part 4 provisions relating to District Development Committee, and Part 5 provisions relating to Local Body. Section 189 regulates functions, duties and powers of District Development Committee. These include determination of wages for labour and rate of workmanship at district level, as well as operating programmes on abolition of child labour and rescue of children.

    Amends the Civil Service Act 1993. A new section 2A provides for a Central Body relating to Employee Administration; a new s. 6A concerns the creation of civil service posts; and a new s. 7c prohibits the hiring of persons to perform civil service work on a wage or contract basis. Also amends sections concerning promotion, disqualification of candidacy, temporary appointments, transfers, deputation, evaluation, complaints, and retirement. S. 36 provides that non-gazetted and unclassified employees may form unions.

    Establishes a Consumer Protection Council charged with the promotion of consumer rights. Prohibits price-fixing, hoarding, and other unfair trading practices. Also creates a Compensation Committee which shall award damages in connection with complaints filed under the Act.

    Consists of 6 Chapters, 59 sections and a Schedule. Governs employment and security of service, while setting out maximum hours of work for minors and women. Conditions of employment and working conditions are dealt with in Chapter 3, and health, sanitation and safety matters are provided for in Chapter 4. Chapters 5 and 6 concern administrative aspects relating to bodies such as the Central Labour Advisory Board, the Labour Relations Committee and the Labour Court. The Schedule lists degrees of physical disability according to extent of injury. Repeals the Nepal Factories and Factory-Workers Rules of 1963.

Chapters 2 and 3 provide for the registration, operation, management and recognition of trade unions; Chapter 4 deals with the appointment, functions, duties and powers of registrars; Chapter 5 concerns trade union funds and auditing of such funds; and Chapter 6 provides for miscellaneous matters including trade union amalgamation or merger, disclosure of information by trade unions, cancellation of registration and dissolution of trade unions, and penalties to be imposed on trade union officers for any damage caused by them to their trade unions.
