    The aim of the legal and regulatory analysis is to improve the availability of information and evidence of legal and regulatory aspects in the context of HIV and AIDS, for purposes of making recommendations for creating and strengthening an enabling environment that promotes an effective national AIDS response in accordance with the Republic of Namibia’s National Strategic Framework 2010/11-2015/16 and the National Policy on HIV. The assessment has been conducted by way of a desk review of documentation on selected laws, regulations and policies and a qualitative assessment of the level of knowledge on human rights among key and vulnerable populations; and of the degree of awareness of HIV related laws and human rights among law makers and law enforcers to enable effective implementation of services, access to justice and enforcement of HIV-related laws and rights.

    Provides for affirmative action programmes to promote employment for designated groups, which shall include women, disabled persons, and persons who belong to ethnic groups which are disadvantaged due to racially discriminatory laws or practices before the independence of Namibia. Employers shall give preferential treatment to persons from such designated groups by providing employment and removing employment barriers. Establishes an Employment Equity Commission to oversee the impelmentation of the Act.

    Guidelines for implementation of National Code on HIV/AIDS in employment (No. 78 of 1998). - Guidelines

    Code represents integral part of Government's commitment to address most of the major issues related to the prevention of new HIV/AIDS infections, as well as to the provisions of optimal care and support for the workforce. Code applies to all current and prospective employees, all workplaces and contracts of employment, and all human resources practices forming part of policy component of any organization. Policy components of code focus on: education, awareness and prevention; job access; workplace testing and confidentiality; job status; HIV testing and training; managing illness and job security; occupational benefits; risk management, first aid and compensation; protection against victimisation; grievance handling; information; monitoring and review.

    The Act renders criminally punishable, pursuant to the provisions of Article 23 of the Namibian Constitution, certain acts and practices of racial discrimination and apartheid in relation to public amenities, the provision of goods and services, immovable property, educational and medical institutions, employment, associations, religious services, and involvement in the incitement of racial disharmony and victimisation.
