    These Regulations:
    (a) implement the provisions of Council Directive 2009/13/EC implementing the Agreement concluded by the European Community Shipowners┐ Associations (ECSA) and the European Transport Workers┐ Federation (ETF) on the Maritime Labour Convention, 2006, and amending Directive 1999/63/EC;
    (b) give further effect to Council Directive 1999/63/EC concerning the Agreement on the organisation of working time of seafarers concluded by the European Community Shipowners┐Association (ECSA) and the Federation of Transport Workers┐ Unions in the European Union (FST); and
    (c) implement certain provisions of Article 15 of Directive 2008/106/EC of the European Parliament and of the Council on the minimum level of training of seafarers (as amended by Directive 2012/35/EU).
    These Regulations amend the European Communities (Merchant Shipping) (Organisation of Working Time) Regulations 2003.
    These Regulations provide seafarers with an entitlement to specified minimum hours of rest, require records to be kept of seafarers┐ daily hours of rest and provide for the enforcement of the Regulations. They also provide for a minimum age for seafarers working on ships to which the Regulations apply, set out the conditions under which seafarers under the age of 18 may work at night, and provide for annual leave entitlements for seafarers, as set out in the Maritime Labour Convention, 2006 and in Council Directive 2009/13/EC.

Inter alia, repeals sections 222, 224, 225, and 238 of the Merchant Shipping Act 1894, which set forth penalties for desertion or absence without leave from ships, including conveyance of seafarers back to the ship which they deserted. Also amends penalties for wilful disobedience.

    Sets forth which medical supplies are to be carried aboard specified categories of ships, including life-boats. Determines which types of ships shall provide a sickbay or a medical doctor on board. Owners of vessels which carry dangerous substances shall also carry specified antidotes. Also provides for the establishment of a radio medical consultation service for seafarers.

    The Merchant Shipping Acts, 1894 to 1993, and this Act may be cited together as the Merchant Shipping Acts, 1894 to 1996, and shall be construed together as one.

    These Regulations require masters and other specified persons in merchant ships registered in Ireland to, inter alia, make available to any seafarer on the ship who requests it, a copy of the ILO publication entitled "Accident prevention on board ship at sea and in port".

    These Regulations are intended to give effect in part to the Merchant Shipping (Minimum Standards) Convention, 1976 No. 147 of the ILO. The Regulations require, inter alia, the employers of persons employed on board ships registered in the State, other than fishing vessels and pleasure crafts, to ensure the health and safety aboard ship of all their employees and of other persons who may be affected by their acts or omissions and in particular make provision for the maintenance of plant, machinery and equipment, the use, handling, stowage and transport of articles and substances, and instruction and training.

    These Regulations are intended to give effect in part to the Merchant Shipping (Minimum Standards) Convention, 1976 No. 147 of the ILO. The Regulations require ships registered in the State (other than fishing vessels and pleasure craft) to carry a gangway, an accommodation ladder, safety nets, bulwark ladders, handholds and guardrails in certain circumstances. A ship may be detained if it does not carry the necessary access equipment.

    Amends the Merchant Shipping Acts, 1894 to 1939. Repeals sections 73-74 of the Merchant Shipping Act 1894.

    14. Repeals.
    15. Short title, commencement, construction and collective citation.
