    Provides that in the case of U.K. occupational pension schemes with members who have reckonable Irish service, the provisions of the Pensions Act shall apply with certain modifications to the Irish members of the schemes in respect of such service. The provisions of the Pensions Act which are modified by limiting their application in such cases include those relating to preservation of benefits, funding standards, winding up of schemes and disclosure of information.

Made under the Pensions Act, 1990.

    Provides that members covered by a scheme with not less than 50 qualified members and a directly invested scheme with not less than 12 members may participate in the selection of trustees. The Regulations also provide for, inter alia, nominations, term of office of member trustees (to be 6 years), procedure for the appointment of a Chairperson, the filling of casual vacancies and procedures for reselection of member trustees at the end of their term of office.

    Where employment has terminated and a person has periods of reckonable service in more than one scheme relating to the same employment, the preserved benefit entitlement will be calculated in accordance with these Regulations. Allows for the earlier periods of reckonable service to be enhanced so that the member who transfers within schemes in the same employment will not lose out when he eventually leaves employment and his preserved benefit is being calculated.

    Substitutes the existing regulatory provisions relating to the exemption from the assessment of means in the case of recipients of old age pension of an amount up to 75,000 of the proceeds derived from the sale of the pensioner's principal residence. Provides that the exemption will apply in the case of a recipient (aged 66 or over) of old age pension who sells his house and either purchases alternative accommodation, rents alternative accommodation, or moves into a private nursing home. Revokes the Social Welfare (Old Age and Blind Pensions) Regulations, 1991, other than Part III.

    One of the qualifying conditions for invalidity pension is that the claimant must have been incapable of work for at least 12 months before making his claim. These Regulations also entitle to invalidity pension a person who is incapable of work where evidence is adduced to establish to the satisfaction of a deciding officer or an appeals officer that the incapacity for work is of such nature that the likelihood is that the person will be incapable of work for life. Revokes the Social Welfare (invalidity pension) Regulations, 1970 and the Social Welfare (invalidity pension) (Amendment) Regulations, 1972.

    One of the qualifying conditions for entitlement for Disability Benefit is that the claimant has 13 paid contributions in the governing contribution year. These Regulations exempt recipients of long-term Unemployment Assistance and Pre-Retirement Allowance from this condition. Revokes the Social Welfare (Disability Benefit) Regulations, 1992.

    This Act regulates occupational pension schemes and provides for equal treatment of men and women under occupational benefit schemes, provides for the establishment of a Pension Board to supervise such schemes and their operation and defines the functions of the Pension Board.

    These regulations extend certain provisions of the Social welfare (consolidation) act, 1981 to the new schemes. These provisions deal with a number of administrative matters relating to the making of claims, the method of payments, decisions, appeals, etc. The regulations also prescribe the conditions in which a man may be regarded as having been deserted by his wife for the purposes of the deserted husbands's allowance scheme.

    These Regulations provide entitlement to old-age (contributory) pensions from mid-October 1988 on a pro-rata basis for certain persons who came back into insurance on the abolition of the earnings limit for liability for social insurance contributions in April 1974 but who did not have a sufficient record of contributions to entitle them to pension. The Regulations also provide entitlement to reduced pensions on a similar basis for the widows and deserted wives of such persons.
