Establishes new provisions whereby a person aged 50 or over, whether in full-time or part-time employment, whose salary is reduced or who takes up employment with a new employer at a reduced salary, may, if the person satisfies certain conditions, elect to pay contributions at the old rate of salary uprated by the retail prices index. Regulates the payment of additional contributions. Amends the formula for calculating the retirement lump sum. Amends provisions governing the calculation of average salary and the interest rate on late payments of certain benefits. Makes additional revisions and simplifications.

Amends the Teachers (Compensation for Premature Retirement) (Scotland) Regulations 1996. Amends the existing provisions regarding discretionary compensation for premature retirement. Provides that, in the calculation of the amounts of compensation awarded under the 1996 Regulations, there shall be disregarded the actuarial reduction of the lump sum and pension under the teachers' pension scheme. Gives teachers' employers the power to make discretionary compensation payments for termination of employment to persons whose employment has ceased either because of redundancy or in the interests of the efficient exercise of early payment of pension benefits. Provides for the payment of compensation.

The Regulations add a new paragraph to enable staff aged 50 or over with reckonable service who are eligible to receive payment of compensation in terms of the Local Government (Education Administration) (Compensation for Redundancy or Premature Retirement on Reorganisation) (Scotland) Regulations 1995 (S.I. 1995/840) to waive the right to immediate payment of an annual retirement pension and a retirement lump sum. Also amends the definition of full-time service in Schedule 1 to the 1992 Regulations.

Under section 222, the Secretary of State may by order make modifications in any enactment relating to employment which is considered necessary or expedient under certain ss. of this Act; before such orders are made, organisations representing staff shall be consulted. Voids any contract made after 20 November 1987 which provides that the employee shall not be dismmissed by reason of redundancy (section 221). Amendments and repeals of other statutes appear in Schedules. With stated exceptions, the Act does not extend to Scotland or Northern Ireland (section 238).
