Also introduces a requirement that direct payments may be made to landlords only where the landlord is a fit and proper person to be the recipient of such payments or a local authority is nonetheless satisfied that it is in the claimant's interest to do so. Also establishes the conditions under which housing benefit may be suspended.

Provides for the time and method in which that information is to be provided. Sets penalties for the failure to provide required information.

    Makes numerous amendments to the Local Government Superannuation (Scotland) Regulations 1987. Inter alia, alters the position of women retiring at 60 with less than 25 years' service so that they will no longer be obliged to take their pension at that age but, like men, may elect to do so (s. 3). S. 4 removes an inequality which stipulates under certain conditions a reduction of a man's pension but not of a woman's.

Makes and further amends provisions relating to maximum benefit in cases where housing benefit or council tax benefit was payable, by providing for a further, extended, payment of benefit in prescribed circumstances and makes provision for the effect of such payments on any further grant of benefit.

    Consequential to the Jobseekers Act 1995, it is no longer a condition of entitlement to income support that a claimant be available for and actively seeking employment. The text thus revokes all provisions of the Income Support (General) Regulations 1987 (S.I. 1987/1967) which stipulate that a claimant be available for and actively seeking employment. Also makes numerous other technical amendments.

    Amends provisions in the Housing Benefit (General) Regulations 1987 (S.I. 1987/1971) relating to maximum eligible rent in cases where housing benefit is payable, including conferring a discretion on local authorities to pay a lesser sum in appropriate cases (regulations 3,4 & 5). Also requires local authorities to make certain requests for determinations and redeterminations from rent officers and provide for their consequences (regulations 6&8). Adds a discretion to pay more benefit than would otherwise be payable by reason of these Regulations (regulation 7). In addition, makes provisions relating to claimants whose entitlement commenced before Regulations came into force (regulation 10) and extends protection to partners of such claimants.

    Makes changes in the way housing costs are calculated for income support purposes. The major changes (all to Schedule 3 to the Income Support (General) Regulations 1987 (No. 1967)) are: a standard rate of interest applies to all loans which qualify as housing costs; housing costs are divided into existing housing costs and new housing costs; in the case of existing housing costs, these costs are met in full after the claimant has been entitled to income support for 26 weeks or more; in the case of new housing costs, they are met when the claimant has been entitled to income support for a continuous period of 39 weeks.

    Amends regulation 64 of the Social Security (Adjudication) Regulations 1986 to provide that where a question arises as to what housing costs are to be included in a claimant's applicable amount and those costs cannot be immediately determined, an adjudication officer shall proceed to determine a claim or question on the assumption that the housing costs to be determined in a claimant's applicable amount are those that can be immediately determined. Adds the question as to whether severe disability premium is to be included in a claimant's applicable amount to the list of questions in paragraph (3) of regulation 64. Specifies that these Regulations do not impose a charge on business.

    Amends the Disability Working Allowance (General) Regulations 1991, the Family Credit (General) Regulations 1987 and the Income Support (General) Regulations 1987 in, inter alia, the following respects: (1) treating persons as not being engaged in remunerative work, when they receive payments from certain organizations for providing temporary accommodation and care to a person not normally a member of his household, or when they are in receipt of a training allowance while in a scheme of training or instruction; (2) provisions concerning the period over which the weekly earnings of employed and self-employed earners are to be calculated and; (3) excluding payment made to a claimant by certain organizations for providing temporary accommodation and care to a person not normally a member of his household from consideration as earnings.

Also amends the definitions of "claimant" and "family".

    Provides that service charges for general counselling and support are eligible payments for Housing Benefit only where either the services are related to the provision of adequate accommodation or where the claimant's landlord or the landlord's employee spends the majority of the time, during which he provides services, in the provision of eligible services.

    Amends the provisions in Schedule 3 to the Income Support (General) Regulations 1987 which relate to housing costs. Inserts a new paragraph 5A in Schedule 3 providing that payments made on loans taken out while the claimant or a member of his family is entitled to income support will not be met.
