The Universal Credit Regulations 2013 (S.I. 2013 No. 376). -

These affirmative instruments support the introduction of Universal Credit. The Universal Credit Regulations 2013 make provision for determining entitlement to, and calculation of, an award of Universal Credit.

The Jobseeker’s Allowance Regulations and Employment and Support Allowance Regulations make provision for these benefits to be only payable based on a person’s National Insurance contribution record and no longer through the alternative route of means testing. The rules for contributory entitlement are carried forward largely unchanged, but the regulations do make provision for new conditionality and sanctions regimes in these two benefits, so they are aligned with those for Universal Credit.

The Universal Credit (Transitional Provisions) Regulations 2013 provide that the introduction of Universal Credit and the changes to Jobseeker’s Allowance and Employment and Support Allowance from 29 April 2013 is limited to certain categories of claimant in “Pathfinder” areas.

The Act sets out the new arrangements for the creation of schemes for the payment of pensions and other benefits. It provides powers to Ministers to create such schemes according to a common framework of requirements. The Act provides powers to the Treasury to set specific technical details of certain requirements. It also gives powers to the Pensions Regulator to operate a system of independent oversight of the operation of these schemes.
It is intended that the powers in the Act will supersede powers to create schemes for the payment of pensions and other benefits, including those contained in the following legislation:
- Superannuation Act 1972, for civil servants, people employed in local government service, teachers and persons engaged in health services;
- Fire and Rescue Services Act 2004;
- Armed Forces (Pensions and Compensation) Act 2004;
- Police Pensions Act 1976;
- Judicial Pensions Act 1981; and
- Judicial Pensions and Retirement Act 1993.
The Act protects the benefits already earned by members of existing public service pension schemes and allows continued membership of those schemes for certain categories of person who are closest to retirement.

Implements the amendment made by section 33 of the Welfare Reform Act 2009, which amended section 8 of the Jobseekers Act 1995 to allow for a new sanction to be applied in certain circumstances when a jobseeker's allowance (JSA) claimant fails to attend an appointment. The sanction is that, although entitlement to JSA will continue, the benefit will not be payable for a period of at least one week and not more than two weeks.

These Regulations amend the Jobseeker's Allowance Regulations 1996 on account of the introduction of the employment programme established under section 2 of the Employment and Training Act 1973 (c. 50) known as the Community Task Force. The Community Task Force is an employment programme in which jobseeker's allowance claimants aged over 18 years and less than 25 years are required to participate for up to 13 weeks. It combines work experience and job search activity.

These Regulations make provision as to how sections 2 to 9 of the Pensions Act 2008 ("the employers" duties) apply to employers. These Regulations also set the transitional periods for money purchase and personal pension schemes (in regulation 5) and for defined benefits and hybrid schemes (in regulation 6).
