Employment (Maximum Amount of a Week's Pay) Order 2009 (S.D. 0225/09). - Adoption: 2009-07-20 | GBR-2009-R-81131 This Order increases from £420 to £480 the maximum amount of a week's pay, which is used for calculating (a) the basic award of compensation which may be made by the Employment Tribunal on a complaint of unfair dismissal, and various other awards under the Employment Act 2006 and the Minimum Wage Act 2001, and (b) a redundancy payment under the Redundancy Payments Act 1990. The increase applies where the event giving rise to the entitlement to the award or payment occurred on or after 20th July 2009.

Principle also applies in the areas of wages and pensions. Fixed-term employees will be considered permanent employees if they have been employed on successive fixed-term contracts for a period of four years or more without justification on objective grounds. Collective or workforce agreement may specify maximum total period for which employees may be continuously employed on one or successive fixed-term contracts, maximum number of successive fixed-term contracts and objective grounds justifying renewal of fixed-term contracts.

Section 3 permits the Secretary of State to prevent persons who have not attained the age of 26 from qualifying for the national minimum wage or to prescribe a different hourly rate, from that of the single hourly rate of the national minimum wage, which is to apply to them.

The Secretary may prescribe a different minimum wage for persons under the age of 26. Establishes a Low Pay Commission which shall make recommendations regarding minimum wage. Provides for inspection of records regarding minimum wage and financial penalties for non-compliance. S. 28 provides for the reversal of the burden of proof in respect of complaints that minimum wage was not paid, so that it shall be presumed that minimum wage was not paid unless the contrary is established. Makes subsequent amendments to legislation regarding agricultural wages in Scotland and Northern Ireland.
