S. 9 provides that a dismissal is unfair if the principal reason for it was the performance by an employee representative of his duties and functions. Employment Protection (Increase of Limits) Order 1995 (S.I. No. 1953 of 1995). Adoption: 1995-07-27 | Date of entry into force: 1995-09-27 | GBR-1995-R-41456 Increases certain limits which are required to be reviewed annually by the Secretary of State under section 148 of the Employment Protection (Consolidation) Act 1978. It also raises the limits found in sections 75 and 75A of the 1978 Act and sections 156 and 158 of the Trade Union and Labour Relations (Consolidation) Act 1992. The limits raised include payments made in compensation with regard to a complaint of unfair dismissal, a complaint of unjustifiable discipline, exclusion or expulsion from a trade union, and a complaint on health and safety grounds.

The minimum basic award is relevant to dismissals which are to be regarded as unfair under the Employment Protection (Consolidation) Act 1978 (LS 1984 - UK 1A). The increase in the minimum basic award also affects the minimum amount of compensation that shall be awarded by the Employment Appeal Tribunal in respect of a complaint under section 4 of the Employment Act 1988 (unjustifiable discipline by a trade union); LS 1988 - UK 1).
