    4. To enable persons with disabilities to have a voice;
    5. To identify the factors of vulnerability for persons living with disability (e.g. health security, economic security, family security, social safety nets);
    6. To identify gaps and define actions under a holistic approach in order to promote the inclusion and participation of persons with disability.

    These Regulations implement (in Great Britain) the provisions of Council Directive 2000/78/EC (OJ No. L 303, 2.12.2000, p.16), establishing a general framework for equal treatment in employment and occupation, so far as it relates to disability discrimination but only insofar as the Directive's obligations impact upon Chapter 2 of Part 4 of the Disability Discrimination Act 1995. The Disability Discrimination Act 1995 (Amendment) Regulations 2003 (S.I. 2003/1673), which came into force on 1st October 2004, implemented the Directive's obligations with respect to Parts 2 and 3 of the Act.

    Excludes addictions, certain personality disorders (e.g. pyromania, voyeurism, exhibitionism), conditions related to body piercing and tattoos, and hayfever from the definition of disability. S. 6 provides that children under six shall be treated as if they were over six for the purposes of determining the effect of their disability.

    Provides that employers with a substantial number of employees must employ handicapped persons, and authorises the government to regulate at a later date the number of such persons to be employed, methods for registration of disabled persons seeking employment, and facilities to be provided to them. Buildings open to the public whether on payment or otherwise must be accessible to the disabled, and appropriate sanitary and parking facilities provided to them.

The commencement dates are 1991-10-19 for the powers enabling Regulations to be made; 1992-02-03 for the purposes of making claims for, and the determination of claims and questions relating to, disability living allowance, and attendance allowance where the person has attained the age of 65; 1992-03-10 for the purpose of making claims for, and the determination of claims and questions relating to, disability working allowance; 1992-04-06 for all remaining purposes, apart from up-rating; 1992-05-01, for up-rating.

    Disability Living Allowances and Disability Working Allowance Act 1991 (Chapter 21)

    Introduces as social security benefits a disability living allowance and a disability working allowance; and for connected purposes. Repeals section 37A of the Social Security Act 1975 (mobility allowance) and inserts new sections 37ZA, ZB, ZC, ZD and ZE to provide for a disability living allowance consisting of a care component and a mobility component to be awarded together or separately to eligible mentally or physically disabled persons for life or for a fixed period. Provisions for a disability working allowance are set out in amendments to the Social Security Act 1986 (including new subsections 6A to 6F, new section 27B) and to the 1975 Act. Conditions of eligibility include qualifications for an invalidity pension under sections 15 and 16 of the 1975 Act, for a severe disablement allowance under section 36 thereof, for income support, housing benefit or community charge benefit; or for an attendance allowance under section 35 of the said Act, for a disability living allowance under section 37ZA thereof, etc. Provisions are made for entitlement to other benefits on termination of employment after a period of entitlement to a disability working allowance, entitlement to an invalidity pension on termination of employment after a period of entitlement to a disability working allowance,etc. This Act entered into force on 12 August 1991 in accordance with The Disability Living Allowance and Disability Working Allowance Act 1991 (Commencement No. 1) Order 1991.

    Amends the law relating to social security and to occupational and personal pension schemes; establishes and confers functions of a Pensions Ombudsman and a Registrar of Occupational and Personal Pension Schemes; makes provision for the payment of grants for the improvement of energy efficiency in certain dwellings; and for purposes connected therewith. Amends the Social Security Act 1975 by providing for an attendance allowance for the terminally ill, for an age-related addition to severe disablement allowance and for other matters connected with allowances, invalidity pensions, survivors' benefits, etc. Consequential amendments are made to the Social Security Pensions Act 1975, the Social Security Acts 1975 to 1989, the Industrial Injuries and Diseases (Old Cases) Act 1975 and various other acts.
