    Hours of Work Act (ArbZG). (Arbeitszeitgesetz - ArbZG) - Act on-line in German

    This Act contains the Working Time Act as well as several amendments of other Acts. The Hours of Work Act states the general rule that daily hours of work may not exceed 8 hours, and can only under certain circumstances be extended to 10 hours. Rest periods must be at least 30 minutes per day. After the end of daily hours of work there must be a rest period of at least 11 hours. There are special provisions for night workers and for dangerous work. On Sundays and on Bank Holidays employees may not work except in specific circumstances. Exceptions are possible for temporary work during emergencies.

    Gives each employee the right to take paid holidays. Also provides for both the minimum amount of holidays an employee must receive during one year and a prohibition against employees working during this paid time for another employer.

    Federal Act regarding closing hours for shops.

    Stipulates the regular closing time for all kind of establishments selling merchandise to the public. Exempted from this basic regulation are some shops such as pharmacies, shops in airports, train and gas stations and bakeries. Employees working in enterprises exempted from the legal closing hours must not work more than eight hours on Sundays and statutory holidays, and the employer is obligated to compensate them with a free afternoon during the following working week if they work for more than three hours, and a completely free day, if they work for more than six hours.

    In case of termination of the employment of a public servant during the year, the duration of the accorded leave is one-twelfth of the annual leave for each month of service; in case of retirement, the duration is six twelfths if the retirement occurs in the first half of the year, otherwise it is the entire annual leave.

    Annual leave shall not be divided into two periods except in exceptional circumstances. No annual leave shall be accorded in the first six months of employment. The duration of annual leave shall depend on the age and salary level of the civil servant. Annual leave must be taken at least four months after the end of the year.

    Section 1 (1) of the Hessian Law is contrary to Art. 12 (1) of the Federal Constitution insofar as it obliges the employer to pay full wages during special leave without allowing for possible compensation.

    Sets out the regular hours of work for employees over eighteen years of age; the daily time must be eight hours, but can be raised by wage agreement until ten hours a day. Also stipulates rest periods.

    Amends the Ordinance of 24 September 1974 (as amended to 6 September 1985 (BGBl., Part I, p. 1903)) on hours of work for federal civil servants, changes the reference in s. 1(1) to "40 hours per week" to "39, and from 1 April 1990 on, 38 and one half". Deletes the reference to "15 minutes" from s. 1(2). Replaces the word "daily" in s. 3(2), fourth sentence, with "Mondays to Thursday". Contains special provisions for postal workers.
