It specifically amends article 2, by adding the term "Public Universities of Cyprus" and its definition; article 3, by excluding Private Universities from the scope of the Law and by defining Universities of Cyprus as Public; article 4, by adding a reservation concerning the participation in the activities of the Advisory Committee; article 15, by adjusting the procedure of registration of Institutes; articles 50 and 51.

    In view of better harmonising national legislation with articles 5 para 5 and 25 para 2 of the European Parliament and Council Directive 2004/38/EC of 29 April 2004 on the right of citizens of the Union and their family members to move and reside freely within the territory of the Member States, amending Regulation (EEC) N° 1612/68 and repealing Directives 64/221/EEC, 68/360/EEC, 72/194/EEC, 73/148/EEC, 75/34/EEC, 75/35/EEC, 90/364/EEC, 90/365/EEC and 93/96/EEC, the present Law amends Laws N° 7(I) of 2007 and 181(I) of 2011 on the Right of European Union Citizens and their Family Members to Move and Reside Freely within the Territory of the Republic of Cyprus. Amendments concern the figures to be converted from Cypriot pounds to Euros as they appear in articles: 5 phrase 6 para (c), 10 phrases 4 and 6, 11 phrase 2 para (a), 17 phrase 1, and 18 phrase 1, as well as in Indexes II, III, IV, V and VI.

    - articles: 14.6, 23.2, 24 and 32 of the Council Directive 2004/83/EC of 29 April 2004 on minimum standards for the qualification and status of third-country nationals or stateless persons as refugees or as persons who otherwise need international protection and the content of the protection granted, the present Law amends Laws on Refugees N° 6(I) of 2000, 6(I) of 2002, 53(I) and 67(I) of 2003, 9(I) and 241(I) of 2004, 154(I) of 2005, 112(I) of 2007 and 122(I) of 2009. Amendments concern the administrative procedure of applying for, granting, refusing and withdrawing refugee status.

    The Law amends Laws N° 5 of 1960, 55 of 1968, 210 of 1990 and 77(I) of 2009 related to Dock Workers and the regulation of their employment. It specifically amends article 3(1) concerning the employment regulation and the establishment of a "Dock Work Council", competent for the regulation of wages and of the employment and working conditions in one or more ports. It further adds new paragraph (3) to article 3, concerning the coverage of extraordinary needs in dock workers by the existing registered dock workers of every "Dock Work Council".

    The present Law repeals and replaces the Laws N° 113(I) and 191(I) of 2011 on the Retirement Benefits of Public Servants and Employees in the Broader Public Sector, including the Local Authorities.
    Article 2 provides for the definition of the following terms: "actuarial reduction", "actuarial conversion", "deductions", "teacher", "Republic", "Broader Public Sector", "European Union", "position", "medical officers", "professor", "Regulation N° 31 (EEC), 11 (EAEC) of 1962", "Public Service", "governmental pension scheme", "Police member", "new entrants to employment", "pertinent Law or Regulations", "periodical contributions", "pensionary emoluments", "retirement benefits", "pensionary", "pension scheme similar to the governmental one" and "employee".
    Article 3 defines the purpose and the scope of application of the present Law.
    Article 4 regulates the procedure of deduction from the monthly pensionary emoluments, whose amount is equal to 3% of the salary.
    Article 5 fixes the amount of the periodical contributions.
    Article 6 prohibits the refund of the periodical contributions.
    Article 7 adjusts the pension rate and fixes the lump sum for the duty time provided before and after the 1st January 2013.
    Article 8 introduces taxation for the lump sum and for any bonus gained on duty from the 1st January 2013 onwards.
    Article 9 specifies the mandatory retirement age.
    Article 10 regulates the voluntary premature retirement.
    Article 11 introduces the actuarial reduction in pension.
    Article 12 excludes the latest spouse of a deceased retired employee from the survivors' benefit, in case of post-retirement death of the previous spouse, followed by the death of the retired employee.
    Article 13 regulates the retirement benefits of the new entrants to employment.
    Article 14 repeals and replaces the Laws N° 113(I) and 191(I) of 2011 on the Retirement Benefits of Public Servants and Employees in the Broader Public Sector, including the Local Authorities (Provisions of General Implementation).
    Article 15, determines the present Law's date of entry into force as of the 1st January 2013.
    The Law also provides for the relevant Indexes.

It introduces amendments to article 2, concerning the definition of "Private Sector" (article 2), and to article 3, replacing "2013" by "2016" (article 3). It adds new article 7A regarding the recognition of employment for the purposes of granting accruals to the teaching and academic personnel (article 4). It further amends article 8, concerning the index-readjustment of emoluments and pensions (article 5(a)), the non-granting of wage increase for 2012 and the readjustment of the wage increase for 2017 (article 5(b)), as well as article 10, concerning the partial entry into force of the Law (article 6).

    The Law introduces amendments to the following articles of the Laws N° 59(I), 114(I) and 126(I) of 2010 and 2(I), 37(I) and 170(I) of 2012 on Social Security:
    - article 2, concerning the readjustment of the retirement age;
    - article 5, concerning the amount of contributions incumbent upon employees, employers and the Permanent Fund of the Republic for the period of 2014 to 2039;
    - article 6, concerning the amount of the insurable earnings for the period of 2014 to 2039;
    - article 12, concerning the amount of due contributions for the contributions years 2014 to 2039;
    - article 15, concerning the amount of due contributions incumbent upon the insured persons and the Permanent Fund of the Republic for the contributions years 2014 to 2039;
    - and article 27, concerning the abolishment of the marriage benefit.
    It furthers adds new article 35A introducing a reduction in the old age benefit. It amends article 62 by excluding the insured employed spouse from the dependent person status. It suspends the application of article 77 from 1st January 2013 to 31st December 2016. It further amends:
    - Index III concerning the time of insurance coverage for the period of 2013 to 2017;
    - Index IV, concerning the readjustment of the pregnancy allowance, the funeral grant, the old age benefit, the invalidity benefit and the survivors benefit and their due amount for the period of 7th January 2013 to 1st January 2017;
    - and Index V, concerning the extension of the present adjustment to cover the insured wife, as well as the due amount of the benefits for the period of 7th January 2013 to 1st January 2017.

    Article 3 introduces and frames the reduction in emoluments of Officials and Employees and in pensions of Pensioners.
    Article 4 determines the calculation of pension benefits.
    Article 5 regulates the calculation of compensation and other fringe benefits assessed on the basis of the pay scale or the permanent salaries.
    Article 6 decides upon the amount resulting from the reduction in emoluments and pensions effected within the Public Service and the broader Public Sector.
    Article 7 exempts the reduced amount of emoluments and pensions from the taxable income.
    Article 8 regulates the resolution of issues stemming from the implementation of the present Law.
    Article 9, concerning the Law¿s entry into force, specifies that paras (a) and (b) of article 3 are applicable upon the emoluments of December 2012 onwards, including the 13th wage of 2012, whereas para (c) of article 3 is applicable upon the emoluments of January 2014 onwards.

    - amendment of article 18P (3rd phrase), concerning the procedure of ordering deportation in case of non compliance with the return decision;
    - and replacement of Appendix X.

    In view of transposing Council Directive 2009/50/EC (of 25 May 2009 on the conditions of entry and residence of third-country nationals for the purposes of highly qualified employment) into the national legislation, the Law N° 41(I) of 2012 amends Acts N° 2(I) of 1972, 54(I) of 1976, 50(I) of 1988, 197(I) of 1989, 100(I) of 1996, 43(I) of 1997, 14(I) of 1998, 22(I) and 164(I) of 2001, 88(I) and 220(I) of 2002, 66(I) of 2003, 178(I) of 2004, 8(I) and 184(I) of 2007, 29(I) and 143(I) of 2009 and 153(I) of 2011 consolidating the Aliens and Immigration Law, by adding the following articles:
    - article 18SA, introducing a general reservation in favor of the provisions 18SB to 18YB against any contrary provision of the Law or of the regulations and decrees issued under its authority;
    - article 18SB, providing for the definition of the following terms: "highly qualified employment", "second Member State", "Decree", "Regulation (EC) N° 1030/2002", "family members", "employee", "EU Blue Card", "regulated profession", "Directive 2009/50/EC", "citizen of European Union", "first Member State", "higher education qualification", "third-country national" and "higher professional qualifications";
    - article 18SC, defining the personal scope of application of provisions 18SB to 18YB by specifying the categories of third-country nationals for which the provisions are not applicable;
    - article 18SD, listing the more favourable provisions to which articles 18SB to 18YB shall be without prejudice
    - article 18SE, determining the admission criteria;
    - article 18SST, regulating the volumes of admission;
    - article 18SZ, concerning the EU Blue Card;
    - articles 18SH and following, providing for the grounds for refusal, withdrawal or non-renewal of the EU Blue Card;
    - article 18T and 18TA, regarding applications for admission and for renewal of the EU Blue Card;
    - article 18TB, introducing procedural safeguards;
    - articles 18TC, 18TD, 18TE and 18TST, concerning, respectively, the labour market access, the temporary unemployment, the equal treatment and the family members;
    - article 18TZ, adjusting the EC long-term resident status for EU Blue Card holders;
    - article 18TH, regulating the long-term residence permit;
    - article 18TY, regarding the residence in the Republic Cyprus as a second Member State for family members;
    - article 18TYA on the implementing measures
    - and article 18TYB on the contact points.
    Amends the Appendix III and adds the new Appendix XII to the Aliens and Immigration Law.

It introduces:
    - article 26A concerning the right of transfer of pension benefits from the Public Sector pension scheme to the European Union pension scheme
    - and article 26B concerning the right of transfer of pension benefits from the European Union pension scheme to the Public Sector pension scheme.

    Law N° 15(I) of 2012 amending Law N° 48(I) of 2001 concerning the Protection of Young Persons at Work. - Text in Greek

    Article 2 of Law N° 15(I) of 2012 replaces article 3 of Law N° 48(I) of 2001 regarding the Law's scope of application, which covers the employment of young persons by any employer and excludes the circumstantial, temporary and short term employment that is considered as non prejudicial, non detrimental and non hazardous for the adolescents working at family business. Article 3 of the present Law, by supplementing article 6 of the amended Law N° 48(I) of 2001, ensures an at least one-month-period of free work during school vacations for children placed under a combined dual programme of training and work. Article 4 of the present Law introduces additional provision to article 7 of the amended Law, which provides that children employed in the activities specified under the present article should be accompanied, during their working hours, by their parent or guardian or, if not possible, by an authorized minder. Article 6 of Law N° 15(I) of 2012 abolishes articles 14, 19 and 20 and appendices I and II of Law N° 48(I) of 2001. Article 8 of the present Law amends article 24 of Law N° 48(I) of 2001, by requiring the labor inspectors' continuing vocational training on the rights of the child and protection of its interests, as well as the taking of necessary measures to facilitate the exercise of their duty. Article 13 of the present Law inserts new article 31B concerning the constitution of an "Advisory Committee for the Employment of Children", competent for general policy issues during the application of the present Law.

    This Law may be cited as the Waste (Amendment) Law of 2012 and shall be read as one with the Waste Law of 2011 (hereinafter referred to as "the principal Law"). The present law brings forth minor amendments to article 54 to the principal law by replacing paragraph (e) and by adding a new section (2A).

    Amending the following articles of Law No. 32 of 1987 as amended to Law No. 150(I) of 2004:

    Article 2: adds definition of the term "exercising an agricultural activity".
    Adds article 2A with a more detailed analysis of the profession of farmer.
    Article 3: adds a new para concerning the role of the Council.
    Article 4: adds a sub-para concerning the need for language skills for exercising the profession of famrer. Replaces sub-para 2 with a new sub-para concerning the procedure of applications submission by citizens of EU member states and a new sub-para 3 concerning the evaluation of applications by the Council.
    Article 11C: replaces the phrase "registered in the registry of farmers who provide services" with the phrase "who provide services to the Republic according to article 11A"
    Article 15: adds a new article 15A concerning the appointment and competences of the authorized officer.
    Article 30: replaces the 12th paragraph with a new paragraph concerning the determination and publication of the criteria for the exercise of the profession of farmer based on the academic qualifications. Adds a 13th paragraph confirming that every issue can and should be determined.

    Article 3: amends para. b of subpara. 2 concerning the minimum service of at least 7 years, and substituting in subpara. 5 the word "five" with this of "three".
    Article 4: amends para. b of subpara. 1 concerning the ethical standards of doctors. Amends subpara. 3 concerning penal sanctions.
    Article 6A: change of currency. Adds a new article 6B concerning the implementation of penal provisions against doctors citizens of member state who provide medical services in Cyprus occasionally and provisionally.
    Article 8: concerns composition of Local Medical Association.
    Article 10: concerns functioning of the Local Medical Association.
    Article 11: concerns the general assembly of the Pan-Cypriot Medical Association.
    Article 12: substitutes the word "three" with the word "four" in subpara. 1.

    The Law aims at harmonizing the Cypriot legislative framework with Directive 2008/98/EC on waste and intends creating the suitable legislative framework for harmonizing the Cypriot legislation, through secondary legislation, with a number of other related EU directives. The Law also provides for the implementation at a national level of Regulation (EC) No. 1013/2006 on shipments of waste, as last amended with Commission Regulation (EU) No. 664/2011.
