    Law by which some additional prerequisites are prescribed for the exercice of certain functions in the state organs and organisations of the Czech and Slovak Federal Republic, Czeck Republic and Slovak Republic.

    Persons who, during the period from 25 February 1948 to 17 November 1989, were members or conscious collaborators of the State Security, or members or officials of an organ or authority of the Communist Party at a district or higher level (except those who held these functions only during the period from 1 January 1968 to 1 May 1969), or members of an Action Committee of the National Front or a Screening Committee after 25 February 1948 or a Screening and Normalisation Committee after 21 August 1968, or of the People's Militias, or students, teachers or trainees at USSR High Schools on State security and ideology may not exercise higher management functions filled by election, appointment or assignment in the State Administration, the Czechoslovak Army, the Federal Security Intelligence Service, the Federal and Palace Guard Police Forces, in the Offices of the President, Federal Assembly, Czech and Slovak National Councils, Federal, Czech and Slovak Governments, Federal, Czech and Slovak Supreme Courts and Constitutional Courts, Presidiums of the Czechoslovak and Slovak Academies of Science, in any judicial position, in state broadcasting and television institutions an press agencies and in certain public service institutions and commercial occupation granted by the State. In justified instances, the condition may be waived if the application of the Law should interfere with an important security interest of the State and unless its purpose should be counteracted thereby. In the event of a complaint to be made before an independant committee, the persons concerned have to prove that they do not belong to any of the categories referred to in the Law. The provisions of the Labour Code to the effect that an organisation can give notice of recall only after previous consent of the appropriate union organ (art. 59, paras. 2-4) is not applicable to the termination of employment according to this Law.

    These measures provide for the creation and functioning of a fund serving as a trust organised for all matters in respect of the purchase, sale, export and import of agricultural and agro-food products while guaranteeing minimum purchase prices.

    This Act enacted upon the application of the Federal Act of 21 March 1991 governing land ownership and other agricultural assets relations, concerns all persons who are parties, in whatever capacity, to land ownership and other agricultural assets relations; in specific cases it provides for the simplification and acceleration of the restitution of assets.

    Act governing the relationship between land and other agricultural property. No. 229.

    The purpose of this Act is to compensate for wrongs caused to owners of agricultural and silvicultural property between 1948 and 1989. The Act governs the rights and obligations of owners of real estate, of those using land, and of farmers; the rights of agricultural cooperatives are retained subject to the Act of 3 May 1990 (Text No. 162). It distinguishes between those who are entitled to compensation (those who were defrauded or their heirs) and "persons who are responsible" (the State or persons having possession of the property in question). Among the former are counted those who were excluded from a production cooperative pursuant to the Act of 9 July 1959 concerning consolidated agricultural cooperatives, or the Act of 13 November 1975 concerning agricultural cooperatives . It describes the kind of compensation that is due, the methods for its allocation, and the necessary settlements; it also provides for a general inventory of property. Certain provisions of the above cited Act of 3 May 1990 are repealed.

    This Act amends the Act of 18 April, 1990 (Text No. 105) [ISN 22456] on Citizens' Private Enterprise Act by inserting Part IIA entitled "Agricultural production instituted by private growers". Repeals in Part II of this Act provisions related to such private growers

    Notification of the Minister of Labour and Social Affairs of the Czech Republic, providing for the payment of salary supplements in organisations that do not carry out business activities, in partial compensation for the increase in essential expenditures. No. 225.

    The staff of the bodies affected will receive monthly supplements under Section III(1) on the right to wage and Section III(2) on the determination of wages, taking into consideration sections 83 on hours of work and 86 on reduced hours of work of the Labour Code [SL 1975-Cz.2].

    Act on the Conditions of Transfer of State Property to Other Persons.

    An Act to provide for and regulate the transfer (privatisation) of prescribed State enterprises, banks, insurance companies and other organisations (see Sec.1(3) and Sec.4) to Czechoslovak or foreign legal or natural persons. Provisions are made for various administrative and financial aspects, including preparation and government approval of proposed privatisation projects, the establishment and operation of special Federal and Republic Funds to administer privatisation transactions outside the State budget, the issue of non-transferrable "investment coupons" entitling the bearer to purchase specific shares, and other matters connected therewith.

    An Act providing for so-called small privatization, namely the sale by public auction, generally to citizens of the Czech and Slovak Federative Republic or to persons who were Czechoslovak citizens after 28 February 1948, of certain movable and immovable public assets located in Czechoslovakia, as defined in section 2. Detailed provisions are made for auctioning procedures (Secs.4-17) and requirements to be met by buyers.

    This Notification sets out the principle of wage scales based on the division of occupational duties into a number of broad categories.

    Notification of the Federal Ministry of Labour and Social Affairs to amend and supplement Notification No. 149 (16 September 1988) under the Social Security Act (16 June 1988), Notification No. 165/1979 respecting health insurance for certain workers and the provision of health insurance benefits to citizens in special circumstances and Notification No. 91 (28 December 1958) to set forth provisions of the Central Council of Trade Unions respecting the organization and management of the workers' health insurance scheme.     Made under the Act respecting the sickness insurance of employees of 30 November 1956 (LS, 1956-Cz.3-B). The amendments introduced by the Notification include the insertion in the Notification of 16 June 1988 of provisions covering civil servants.

    Notification of the Czechoslovakia Bureau of Mines respecting the inspection periods for electrical equipments, and the re-examination of inspectors of electrical equipment subject to control by the organs of the state mining administration. No. 60.

    The length of inspection periods depends on the type of workplace and lasts either one or two years. Safety inspectors are trained and examined in accordance with the type of mining activity. The testing of inspectors is furthermore classified according to the electrical equipment which they are supposed to control. The examination is both oral and written and its content is laid down in s.3. Inspectors have to undergo re-examination every 3 years..

    Ordinance of the Government of the Czechoslovak Socialist Republic respecting the increase of special bonuses of miners.

    The ordinance raises the monthly bonuses to 1500,-Kcs for miners working in less risky mines and to 1800,-Kcs in other cases.

    The Notification, which contains seven parts, provides for the requirements of Health and accident prevention as applied to all mineral extraction activities, except in the processing and refinements of gaz, oil and other liquids. The first part contains general provisions in regard to infrastructure, qualification of personnel and emergency procedures. Working conditions in mineral-dressing processes, safety measures as applied to the electrical and mechanical equipment, transport and storage, and operation of processing and refinement equipment are also covered.

    This Act contains 179 sections in 7 Parts, entitled as follows : Preliminary provisions (in particular, classification of occupations into three labour categories); Pension scheme; Social welfare scheme; Members of public security forces and correctional educational services; Adjustment of pensions currently being paid; Transitional and final provisions (indicating that the following texts, inter alia, are repealed: Act of 19 Dec. 1968 (as amended), Act of 12 Nov. 1975 (LS 1975 - Czech. 3), as amended by the Act of 13 Nov. 1979, Legislative Order of 27 Jan. 1982 Act of 23 June 1982 and Legislative Order of 27 Jan. 1982). The present Act entered into force 1 Oct. 1988. A note states that other laws, such as the Act of 17 Mar. 1966 on public health and the Act of 4 June 1964 (LS 1964 - Czech. 2B), as amended by the Act of 19 Dec. 1968, remain applicable.

    The restructuring provided for by this text involves in particular detailed provisions for the application of the Notification of 3 July 1970 (Text 74) regarding termination of employment, placement and income security for employees. The restructuring is to take place in nine stages (from 31 Mar. 1988 to 31 Mar. 1990).
