    Act concerning compensatory indemnification upon termination of the employment relationship. No. 195.

    This Act provides for termination in the event of structural changes or rationalisation measures within the enterprise. The Act does not apply where particular laws provide otherwise. The indemnification owed is calculated on the basis of average earnings (Section 275 of the Labour Code: LS 1975-Cz.2, most recently amended by the Act of the Worker No. 167 of 1991 (Sb.z., 20 May 1991)). This Act repeals the Notification for the same purposes of 3 July 1970 [ISN= 17462], and Notification No. 195 of 1989 on worker protection in the event of structural changes.

    Notification of the President of the Government of the Czech and Slovak Federal Republic, amending and consolidating the Ordinance of the Government of the Socialist Czechoslovakian Republic (of 23 April, 1975) providing for the application of the Labour Code [of 16 June 1965: LS 1975-Cz. 2].     This new Ordinance replaces that of 23 April 1975, as modified on 27 March 1985, by repealing certain provisions and adding a new section (s.24a) concerning responsibilities of the enterprise in the event of termination of activities on the basis of the public interest. Legislative measures of the Praesidium of the Federal Assembly dated 30 August 1990 are reflected, which extend the scope of the appointment by nomination of those engaged to carry out management duties. In the Annex circumstances are set out under which staff reductions may be made.

    Provides for a new section (s.17a) to be inserted into the Agricultural Cooperative Act of 3 May 1990 (Text No. 162), respecting termination of employment relationships.

    This Act cancels a significant number of judicial decisions made between 25 February 1948 and 1 January 1990 under various Acts, including the Act of 18 December 1969 respecting misdemeanours. The Act is divided into eight parts; the sixth, entitled "Compensation", covers unfair dismissal among other matters. (English translation available).

    The basic statutory provisions approved by the Revolutionary Trade Union Movement are approved also, mutatis mutandis, in respect of relations with employers established by trade union bodies and organisations on the basis of free trade union organisation; this applies inter alia to the termination of employment relationships under s. 59 of the Labour Code (LS, 1975-Cz.2) as amended at December 1988 and to the arbitration commissions provided for in s.207 et seq of the said Code and in the Notification of 7 April 1975 respecting the examination and settlement of labour disputes (ibid., 1975-Cz.1).

    Notification of the Federal Ministry of Labour and Social Affairs issuing regulations regarding termination of employment, placement and income security for employees, in conjunction with the reorganisation of the national economy and its central bodies. Text No. 82.

    This text makes applicable, unless otherwise indicated, the Principles and Procedures of 11 Feb. 1988 (Text 31) and, with regard to the reorganisation of "central bodies", the Notification of 3 July 1970 (Text 74). At least three months' notice shall be given to an employee in case of termination of the employment relationship, and the employee shall be granted assistance in seeking new employment. If necessary, he or she shall receive the difference between his or her previous average earnings and the average earnings in the new job for the first three months of new employment, and 80 per cent of this difference over the following three months. The same shall apply in case of a change affecting the enterprise, as stipulated in s. 46(1)(a) to (c) of the Labour Code (LS 1975 - Cz. 2) and in case of restructuring or reduction in force. Acquired rights shall be fully maintained for purposes of ss. 249 to 251 of the Code.

    Principles and Procedures (No. 40) on the basic restructuring of technical, scientific and financial means of production in the national economy, particularly regarding public establishments placed under the control of the Government of the Socialist Republic of Czechoslovakia. Text 31.

    The restructuring provided for by this text involves in particular detailed provisions for the application of the Notification of 3 July 1970 (Text 74) regarding termination of employment, placement and income security for employees. The restructuring is to take place in nine stages (from 31 Mar. 1988 to 31 Mar. 1990).
