Cette loi a pour objet d'établir une nouvelle politique de sécurité du revenu comprenant trois programmes. Elle assure d'abord, par le programme "Soutien financier", le versement de prestations aux personnes incapables d'occuper un emploi. Elle prévoit également un deuxième programme, "Actions positives pour le travail et l'emploi", qui a pour but de favoriser l'intégration au travail des personnes sans emploi en leur offrant des mesures volontaires de maintien et de développement de l'aptitude à l'emploi leur fournissant une assistance financière. Cette loi ne permet plus de retenir le critère de l'âge comme facteur de réduction du niveau de prestations. Elle prévoit que le montant des prestations versées dépend notamment de la disponibiblité d'un prestataire à participer aux mesures offertes par le ministre de la main d'oeuvre et de la sécurité du revenu, de sa participation à de telles mesures, du fait qu'il partage son logement et, dans certains cas, du revenu de ses parents. Enfin la loi, par le programme "Aide aux parents pour leurs revenus de travail", incite les familles avec enfants à demeurer sur le marché du travail ou à y accéder. Elle prévoit ainsi, pour les familles à faibles revenus, une prestation annuelle à titre de supplément au revenu du travail. La loi donne au ministre le pouvoir de verser mensuellement des acomptes de cette prestation. Ce texte apporte à diverses lois les modifications de concordance nécessaires à sa mise en oeuvre, et remplace la loi sur l'aide sociale (L.R.Q., Chap. A. 16).

The effective date is changed from 31 Oct. 1988 to the date on which the Regulations are registered by the Clerk of the Privy Council. This text also amends the criteria for evaluating a claim for exemption.

The amendments provide for the establishment of a Coal Mining Safety Commission and set forth a coal mining employer's duties in relation to safety. The employer must permit inspections and tests on machinery or equipment. No machinery or equipment in respect of which no prescribed safety standards are applicable may be used without approval. Personal searches of a certain proportion of employees, and of all non-employees, entering a mine are required periodically for the purpose of preventing alcohol, smoking materials and drugs from entering the mine. Safety and health committees are to submit an annual report of their activities. With these provisions, new ss. 82.3, 94.1 and 94.2 are added to the Labour Code, and its ss. 92(11), 105 and 106 are amended.

This Act provides for employment standards in the Province of Alberta. By s.18, every employer shall maintain employment records. Division 4 provides for payment of wages, minimum period for computing wages and overtime pay and deductions. Divisions 5 covers hours of work and overtime pay. Section 35 provides for the making of minimum wage Regulations. Section 36 provides for conditions of payment of less than the minimum wage to an individual person who is handicapped. Rules concerning vacations, general holidays and pay therefor are covered by Divisions 7 and 8. Division 9 relates to termination of employment. Parental benefits are provided for in Division 10, employment of young persons, Division 11. Section 77 provides for the appointment of an umpire for the collection of wages, overtime pay, entitlements and parental benefits. Divisions 17 and 18 provide for enforcement of orders of umpires and certain others. Division 20 relates to prohibitions, offenses and penalties. Repeals the Employment standards Act.

This Act amends several provisions of the Labour Code, concerning in particular the definition of hazardous substances (Part II, s. 3) and the obligations they imply for employers (Part II, s. 5). It also amends the Hazardous Products Act, especially regarding methods of manufacturing and preparing such products (containing an amended appendix listing the categories of products in Part I). The amendment promulgates (in Part III) the Hazardous Materials Information Review Act, which establishes a system of review and appeals of decisions taken by screening officers. The new Act sets up the Hazardous Materials Information Review Commission (Part III, ss. 28 et seq.), which includes two workers' representatives.

La présente loi ne porte pas atteinte aux dispositions de la loi sur l'indemnisation des victimes d'actes criminels; elle entraîne des modifications de concordance dans vingt autres lois. Le but de cette loi est d'instituer un nouveau régime d'indemnisation des lesions professionnelles qui remplace les régimes prévus dans la loi antérieur sur les accidents du travail et la loi sur l'indemnité des victimes de amiontose ou de silicose dans les mines ou carrières. Définit la notion de lésion professionnelle comme la blessure ou la maladie causés par un accident de travail ou une maladie professionnelle, comme cité à l'appendix I. Donne aux travailleurs victimes d'une lesion le droit à des prestations d'indemnités, de réadaptation et d'asistance médicale ainsi que le droit d'être incorporé au travail avec le même employeur. Le nouveau régime est applicable à tous les travailleurs victimes d'une lésion dans le territoire du Québec et sous certaines conditions, les travailleurs du Québec victimes en dehors du Québec. L'administration du nouveau régime est soumise à la Comission de la santé et la sécurité du travail, qu'administre son financement et decide quant aux réclamations sous contrôle judiciaire.
