    This enactment establishes a regime, alternative to the one under the Indian Act, to govern the election of chiefs and councillors of certain First Nations.
    Among other things, the regime
    (a) provides that chiefs and councillors hold office for four years;
    (b) provides that the election of a chief or councillor may be contested before a competent court; and
    (c) sets out offences and penalties in relation to the election of a chief or councillor.
    This enactment also allows First Nations to withdraw from the regime by adopting a written code that sets out the rules regarding the election of the members of their council.

    Part 1 enacts the Nunavut Planning and Project Assessment Act, which implements certain provisions of Articles 10 to 12 of the land claims agreement between the Inuit of the Nunavut Settlement Area and Her Majesty the Queen in right of Canada that was ratified, given effect and declared valid by the Nunavut Land Claims Agreement Act, which came into force on July 9, 1993.
    Part 2 enacts the Northwest Territories Surface Rights Board Act, which implements provisions of certain land claim agreements. In particular, that Act establishes the Northwest Territories Surface Rights Board, whose purpose is to resolve matters in dispute relating to terms and conditions of access to lands and waters in the Northwest Territories and the compensation to be paid in respect of that access.

    This enactment provides a new entitlement to Indian registration in response to the decision in McIvor v. Canada (Registrar of Indian and Northern Affairs) that was issued by the Court of Appeal for British Columbia on April 6, 2009.

    The case found that it was unconstitutional to allow registration of a person as an Indian based on paternal and excluding maternal descent. The Indian Act is modified to allow for registration under both the maternal and paternal lines.

Is required, in exercising licensing powers, to consider detrimental effects of potential use of waters or a waste deposit on other water users. Part II establishes Nunavut Surface Rights Tribunal. Tribunal has power to make orders establishing conditions for access to Inuit-owned land, privately owned land and privately occupied Crown land.

Collective agreements between NWT and its public servants shall remain valid for Nunavut public employees.

    Aims to provide equality in the workplace so that no person shall be denied employment opportunities and to correct conditions of disadvantage in employment experienced by women, aboriginal peoples, persons with disabilities and members of visible minorities (s. 2). Applies to private sector employers and specified portions of the public service (s. 4). Employers shall identify and eliminate employment barriers against persons in designated groups and institute policies which ensure that designated groups achieve a degree of representation in the workforce. The measures do not require the employer to hire unqualified persons or create new positions (s. 6). Section 7 provides that if an employer is engaged primarily in serving aboriginal peoples, he or she may give preference to hiring aboriginal peoples, unless this would constitute a discriminatory practice under the Canadian Human Rights Act. Employers shall prepare an employment equity plan setting forth measures which will be taken to correct any deficiencies in the representation of designated groups (s. 10). S. 18 requires every private sector employer to file an annual report detailing the number of persons from designated groups represented in the workforce, as well as their salaries and occupational groups. S. 21 requires a similar report from the President of the Treasury Board concerning employment of designated groups in the public service. Part II delegates power of enforcing the Act to the Canadian Human Rights Commission, and provides regulations thereto. Monetary penalties for violation of the Act are set forth in Part III.
