    This enactment prohibits any person from requiring an individual to undergo a genetic test or disclose the results of a genetic test as a condition of providing goods or services to, entering into or continuing a contract or agreement with, or offering speci‚c conditions in a contract or agreement with, the individual. Exceptions are provided for health care practitioners and researchers. The enactment provides individuals with other protections related to genetic testing and test results.

    The enactment amends the Canada Labour Code to protect employees from being required to undergo or to disclose the results of a genetic test, and provides employees with other protections related to genetic testing and test results. It also amends the Canadian Human Rights Act to prohibit discrimination on the ground of genetic characteristics.

    This enactment provides a new entitlement to Indian registration in response to the decision in McIvor v. Canada (Registrar of Indian and Northern Affairs) that was issued by the Court of Appeal for British Columbia on April 6, 2009.

    The case found that it was unconstitutional to allow registration of a person as an Indian based on paternal and excluding maternal descent. The Indian Act is modified to allow for registration under both the maternal and paternal lines.

En cas de mésentente ou de défaut par un organisme de transmettre son rapport d'analyse d'effectifs ou de se conformer à une recommandation de la Commission, le Tribunal des droits de la personne aura compétence pour décider de la question ou rendre l'ordonnance appropriée. Modifie certaines dispositions de la Charte des droits et libertés de la personne.

    Toute personne employant entre 10 et 50 salariés doit déterminer les ajustements salariaux nécessaires afin d'accorder, pour "un travail équivalent", la même rémunération aux salariés occupant des emplois dans des catégories d'emplois à prédominance féminine que celle accordée aux salariés occupant des emplois des catégories d'emplois à prédominance masculine. Tout employeur de plus de 50 salariés doit établir un programme d'équité salariale, qui doit être mis en place dans un délai de 4 ans. Ce programme comprend 4 étapes: identification des catégories, description des méthodes et outils d'évaluation, estimation des écarts salariaux et calculs des ajustements nécessaires, et modalités de versement des ajustements. L'équité salariale doit par la suite être maintenue dans l'entreprise, notamment lorsque des emplois sont créés ou lorsque qu'une convention collective est renouvelée. Une commission de l'équité salariale est instituée. Elle est composée de 3 membres nommés par le gouvernement, après consultation des organisations les plus représentatives des employeurs, des salariés et des femmes. Ses attributions sont précisées (assistance dans l'élaboration du programme, enquêtes à la suite de différends, recours, etc.).

    Aims to provide equality in the workplace so that no person shall be denied employment opportunities and to correct conditions of disadvantage in employment experienced by women, aboriginal peoples, persons with disabilities and members of visible minorities (s. 2). Applies to private sector employers and specified portions of the public service (s. 4). Employers shall identify and eliminate employment barriers against persons in designated groups and institute policies which ensure that designated groups achieve a degree of representation in the workforce. The measures do not require the employer to hire unqualified persons or create new positions (s. 6). Section 7 provides that if an employer is engaged primarily in serving aboriginal peoples, he or she may give preference to hiring aboriginal peoples, unless this would constitute a discriminatory practice under the Canadian Human Rights Act. Employers shall prepare an employment equity plan setting forth measures which will be taken to correct any deficiencies in the representation of designated groups (s. 10). S. 18 requires every private sector employer to file an annual report detailing the number of persons from designated groups represented in the workforce, as well as their salaries and occupational groups. S. 21 requires a similar report from the President of the Treasury Board concerning employment of designated groups in the public service. Part II delegates power of enforcing the Act to the Canadian Human Rights Commission, and provides regulations thereto. Monetary penalties for violation of the Act are set forth in Part III.

Establishes a Pay Equity Bureau, to provide information and assistance regarding pay equity, to monitor the progress of employers in this regard, to submit a detailed report to the Minister at least every six months, and to perform other related functions. Sets out how pay equity should be implemented. In particular, provides that for the purposes of pay equity value should be determined by applying the criterion of the composite of the skill, effort and responsibility normally required in the performance of the work and the conditions under which the work is performed. Public sector employers are deemed to have complied with the obligation to implement pay equity when it adjusts its pay practices so that female dominated classes are assigned a schedule or range of pay equal to the average or projected average schedule or range of pay of male-dominated classes performing work of equal or comparable value.
