    This enactment amends the mental disorder regime in the Criminal Code and the National Defence Act to specify that the paramount consideration in the decision-making process is the safety of the public and to create a scheme for finding that certain persons who have been found not criminally responsible on account of mental disorder are high-risk accused. It also enhances the involvement of victims in the regime and makes procedural and technical amendments.

    This enactment amends the Criminal Code to prescribe a minimum punishment of five years when a kidnap victim is under sixteen years of age, unless the person who commits the offence is a parent, guardian or person having the lawful care or charge of the victim.

    This enactment replaces sections 83.28 to 83.3 of the Criminal Code to provide for an investigative hearing for the purpose of gathering information for an investigation of a terrorism offence and to allow for the imposition of a recognizance with conditions on a person to prevent them from carrying out a terrorist activity. In addition, the enactment provides for those sections to cease to have effect or for the possible extension of their operation. The enactment also provides that the Attorney General of Canada and the Minister of Public Safety and Emergency Preparedness include in their respective annual reports their opinion on whether those sections should be extended. It also amends the Criminal Code to create offences of leaving or attempting to leave Canada to commit certain terrorism offences.

    The enactment also amends the Canada Evidence Act to allow the Federal Court to order that applications to it with respect to the disclosure of sensitive or potentially injurious information be made public and to allow it to order that hearings related to those applications be heard in private. In addition, the enactment provides for the annual reporting on the operation of the provisions of that Act that relate to the issuance of certificates and fiats.

    The enactment also amends the Security of Information Act to increase, in certain cases, the maximum penalty for harbouring a person who committed an offence under that Act.

    Lastly, it makes technical amendments in response to a parliamentary review of these Acts.

    This enactment amends the Criminal Code to add the offence of trafficking in persons to the offences committed outside Canada for which Canadian citizens or permanent residents may be prosecuted in Canada.

    It also amends the Act to add factors that the Court may consider when determining whether an accused exploits another person.

    This enactment amends the Criminal Code to
    (a) allow for the appointment of a judge as a case management judge;
    (b) define the role and the powers of a case management judge;
    (c) streamline the use of direct indictments preferred under section 577;
    (d) allow for delayed severance orders;
    (e) improve the protection of the identity of jurors;
    (f) increase the maximum number of jurors who can hear the evidence on the merits; and
    (g) provide that, in the case of a mistrial, certain decisions made during the trial are binding on the parties in any new trial.

    Protecting Victims From Sex Offenders Act [2010, c. 17]. - Legislation on-line in French and English

    This enactment amends the Criminal Code, the Sex Offender Information Registration Act and the National Defence Act to enhance police investigation of crimes of a sexual nature and allow police services to use the national database proactively to prevent crimes of a sexual nature.

    It also amends the Criminal Code and the International Transfer of Offenders Act to require sex offenders arriving in Canada to comply with the Sex Offender Information Registration Act.

    It also amends the Criminal Code to provide that sex offenders who are subject to a mandatory requirement to comply with the Sex Offender Information Registration Act are also subject to a mandatory requirement to provide a sample for forensic DNA analysis.

    It also amends the National Defence Act to reflect the amendments to the Criminal Code relating to the registration of sex offenders.

    Establishes the general principles that are to guide the actions of correctional services of the Ministère de la Sécurité Publique, the Commission québécoise des libérations conditionnelles and their community-based partners as well as all other stakeholders of the correctional system as they exercise their respective functions. Underlying these general principles is the objective of protecting society, ensuring compliance with the decisions of the courts and reintegrating offenders into the community.

Part III deals with judicial measures, namely prosecution, right to counsel, notices to parents, detention before sentencing, appearance, release from detention in custody, medical and psychological reports, referral to child welfare agency, and adjudication. Part IV provides for sentencing; Part V for custody and supervision. Part VI deals with publication, records, and information. Finally, Parts 7-9 contain general and transitional provisions.

    This Regulation made under the Ministry of Correctional Services Act amends Regulation 649 of Revised Regulations of Ontario, 1980 by adding a French version of the original English text. R.21 provides that a correctional inmate shall be entitled to all the money that he earns for work performed, and provides procedures for the deposit of the money by the establishment director.
