Labour Inspection Act (ArbIG) (BGBl. 27/1993). (Arbeitsinspektionsgesetz (ArbIG)) - Adoption: 1993-04-01 | Date of entry into force: 1993-04-01 | AUT-1993-L-42243 Concerns establishment of an administrative authority to ensure the protection of employees' occupational safety and health, especially regarding those standards dealing with occupational accidents, applicable also in particular to young workers, disabled persons and pregnant women. The labour inspectors also ensure that rest periods are taken. To achieve these objectives, the labour inspector visits the enterprises from time to time and also must write an annual report for the ministry for labour and social affairs about such inspections. In the event that an employer does not pay attention to laws applying labour law standards, the inspector first requests that the employer stop violating these laws and if the employer still does not do so, the inspector takes the necessary occupational protective measures, and then gives the employer notice that it must pay a certain amount as a result of its illegal behaviour. Adoption: 1986-07-03 | AUT-1986-L-2471 The Act makes amendments concerning general organisational matters, the legal status of works council members and penalties for infringements. It also extends the powers of the works councils, in particular regarding inspections, data stored on computer, unfavourable transfers of employees, information about financial prospects, and interim representation of the interests of employees in new plants. Further, the Act introduces a central youth council and extends the legislative provisions on co-determination to previously exempt organisations, in certain circumstances.
