    These Regulations replace the Merchant Shipping (Maritime Labour Convention, 2006) Regulations 2011. The main change is to provide in the Schedule more detailed national standards with which shipowners have to comply, (though without substantive change). This results from discussions in the International Labour Office in December on the application of the Convention, and also the experience of Recognised Organisations and shipowners on the operation of the Regulations. In addition there are changes to the body of the Regulations, in that the requirements on certification is now placed in the Schedule, and the application to non-Antigua and Barbuda ships made more precise and in line with the planned operation of the Convention.

    Establece que las Organizaciones Sindicales legalmente constituidas de todo el país que agrupan a los trabajadores que prestan servicios a bordo de los buques pesqueros de bandera nacional deberán proveer, en forma quincenal a la Subsecretaria de Pesca, una nómina del personal nacional o extranjero con más de 10 años de residencia permanente efectivamente acreditada en el país, disponible y legalmente habilitado, discriminado por tipo de labor y de buque para el que se encuentra capacitado, a efectos de ser embarcado en forma inmediata en los buques pesqueros.

    Establece que en los buques y artefactos navales de bandera extranjera que se encuentran bajo el régimen de excepción instituidos por los decretos núm. 1772, de 3.9.1991 (según modificado hasta la fecha), núm. 1493, de 20.8.92 (según modificado hasta la fecha) y núm. 343, de 16.4.98, cuando el contrato de ajuste sea celebrado por un empresario, armador u operador legal nacional o extranjero, éste deberá efectuar durante la vigencia del contrato, respecto de los tripulantes argentinos, las contribuciones patronales y aportaciones previsionales que correspondan de acuerdo a la Ley núm. 24.241.

También regula las condiciones de obtención de los certificados de capacidad naútica, marinero, auxiliar de máquinas navales, y la capacitación especial para capitanes costeros. El capítulo 4 se refiere a la formación de prácticos, baqueanos fluviales y a los certificados de conocimiento de zona, el capítulo 5 se refiere a los máximos de cargo.

    El artículo 16 del decreto núm. 817 de 1992 había dispuesto que en 90 días quedaban derogados ciertos decretos para ser reemplazados por nuevas normativas, pero la elaboración de éstas requiere más tiempo a causa de su complejidad. Para evitar un vacío normativo se restablece la vigencia de dichos decretos.

    El artículo 16 del decreto núm. 817 de 26 de mayo de 1992 confirió a la Prefectura Naval Argentina un plazo de 90 días para presentar los proyectos de nuevos regímenes de la navegación marítima, fluvial y lacustre y de la seguridad portuaria. Dada la imposibilidad de promulgar las nuevas normas dentro del plazo previsto, se reintegra la vigencia por el término de 60 días de las normas que regulaban dichos regímenes, decretos núms. 4516/73 y 890/80, respectivamente.
