    The Labour Resources Temporary Contracting Act is designed to protect workers who are engaged by one party but made available to perform work for a third party (ss. 1 to 3). Division I defines the Act's scope of application; Division II lays down general principles. The employer's responsibilities, especially regarding social security, are not affected by a contracting arrangement (s. 5). An agreement between the party engaging the worker and the contracted worker which seeks to evade legal obligations is prohibited (s. 8(2)). The contracting of workers to a firm in which there is a strike or a lock-out is also banned (s. 9). Division III of the Act lays down rules governing the protection of wages, minimum notice prior to dismissal, etc., and sets limits on the circumstances in which contracted workers may be used (not, for example, to reduce the number of regularly employed staff). The contracting of workers from abroad to Austria is permitted only when such engagement meets the criteria set forth in the Act (s. 16). The new Act contains administrative and penalty provisions as well. Conforming amendments are made to the Labour Market Promotion Act, the Works' Constitution Act and the General Social Security Act. New ss. 323a to 323d on labour contracting are added to the Ordinance governing the trades.

    This Act changes the title of the 1972 Act to the Construction Workers' Leave and Termination Act. It introduces a new Division III, entitled Conditions of Termination (ss. 13a-13h), which governs rights to severance pay in various cases. The amount of severance pay ranges from two months' wages for a worker who has completed 156 weeks of employment to twelve months' wages for a worker having worked over 1300 weeks (s. 13d). The Act also amends sections dealing with administration of the Leave and Severance Pay Fund and its financing and makes miscellaneous conforming amendments. A new subsection (3) is added to s. 2 of the Workers' Termination Act of 1979 in regard to calculating continuous service. The Insolvency (Wage Guarantee) Act is amended to provide, inter alia, that employers are to pay a supplement; when it has been paid, no claim to severance pay can be made in case of insolvency (amendment of s. 12(1)(Z) and addition of subs. Z5 to s. 1(3)). With the exceptions detailed in Part V of this Act, the amendments entered into force 1 Oct. 1987.

    This Act introduces numerous amendments to the General Social Security Act (LS 1955 - Aus. 3... 1961 - Aus. 2), particularly in regard to retirement pensions, employment injury and sickness insurance. In a measure to be phased in by 1994, time spent in full-time education will no longer count towards entitlement to a pension. In addition, the period on which average wages are based for purposes of calculating a pension will be extended from 10 to 15 years, also on a phased-in basis until 1992. Where a person receives two pensions, a portion of the second pension which exceeds a certain amount will be withheld. The Act also provides for pension insurance for time spent caring for a handicapped child and introduces new provisions regarding employment injuries involving a person who is over the age of 50. Finally, it contains transitional measures under the Special Assistance Act (BGBl. 642/1973, as amended) and the Act on night shift work and heavy work (BGBl. 354/1981, as amended).

Henceforth, the benefit will be calculated on the basis of average earnings for the six months immediately preceding unemployment, instead of on the last monthly salary.
