    El decreto citado reglamenta la Ley núm. 19691, que establece normas de promoción del trabajo en la actividad privada para personas con discapacidad. En tal sentido, establece su ámbito de aplicación, regula lo atinente a la difusión de las convocatorias para ingreso de personal, la cobertura de los servicios de los operadores laborales, el apoyo laboral y la certificación de la discapacidad. Finalmente, fija la escala conforme a la cual se realizarán en forma gradual los aportes jubilatorios patronales correspondientes a las personas con discapacidad que ingresaren a trabajar a partir del 18 de noviembre de 2018.

    La ley citada establece la obligación de los empleadores de la actividad privada que cuenten con 25 o más trabajadores permanentes, en todo nuevo ingreso de personal que se produzca a partir de la vigencia de la ley, de emplear a personas con discapacidad que reúnan condiciones y la idoneidad para el cargo, en los porcentajes aplicados sobre la totalidad de sus trabajadores permanentes que señala. Reconoce a las personas con discapacidad empleadas de conformidad con la ley todos los derechos y obligaciones previstos por la normativa laboral. Faculta a las personas con discapacidad a solicitar apoyo al empleador para el cumplimiento de las obligaciones laborales. Dispone que el alcance, las condiciones y la duración del apoyo laboral sean reglamentados por el Poder Ejecutivo. Impone a los empleadores el deber de generar las condiciones adecuadas en el puesto de trabajo sobre accesibilidad según las normas vigentes en esa materia, y ejecutar a tales efectos las adaptaciones necesarias para el adecuado desempeño de las funciones del trabajador. Para el caso de despido sin causa razonable, dispone el pago de un importe equivalente a seis meses de salario más la indemnización legal que corresponda y la obligación de contratar a otra persona con discapacidad en sustitución del empleado cesado dentro del término de tres meses a contar de dicho despido.

    Establece un sistema de protección integral a las personas con discapacidad, tendiente a asegurarles su atención médica, su educación, su rehabilitación física, psíquica, social, económica y profesional y su cobertura de seguridad social, así como otorgarles los beneficios, las prestaciones y estímulos que permitan neutralizar las desventajas que la discapacidad les provoca y les dé la oportunidad, mediante su esfuerzo, de desempeñar en la comunidad un rol equivalente al que ejercen las demás personas.
    El capítulo VIII "Trabajo" estipula que la orientación y la rehabilitación laboral y profesional deberán dispensarse en todas las personas con discapacidad según su vocación, posibilidades y necesidades y que se procurará facilitarles el ejercicio de una actividad remunerada.

    Tiene por objeto desarrollar los medios y mecanismos que garanticen el desarrollo integral de las personas con discapacidad de manera plena y autónoma, de acuerdo con sus capacidades, y lograr la integración a la vida familiar y comunitaria, mediante su participación directa como ciudadanos y ciudadanos plenos de derechos y la participación solidaria de la sociedad y la familia.
    El Capítulo III (artículos 26-30) del Título II se refiere al trabajo y la capacitación, en especial a políticas laborales, formación para el trabajo, empleo para personas con discapacidad, empleo con apoyo integral e inserción y reinserción laboral.
    El Título III contempla en Sistema Nacional de Atención integral a las personas con discapacidad.

    Se establece el Consejo Nacional para la integración de las personas incapacitadas. El Título III de la ley trata de la integración social de las personas incapacitadas: gozan del pleno ejercicio de sus derechos, tienen acceso a la educación, a la salud (equipos y prótesis que faciliten su integración), derecho a la asistencia y libre acceso a los servicios e instalaciones de uso público. Los artículos 23 a 25 tratan del derecho al trabajo y el artículo 25 dispone que las empresas públicas o privadas que empleen más de 50 trabajadores tienen la obligación de emplear un mínimo de dos por ciento de incapacitados, siempre que los trabajadores incapacitados reúnan las condiciones de aptitud y capacitación laboral necesarias para el ejercicio de los cargos ofertados.
