    This Act provides in 62 articles divided into 13 Parts the principles of environment protection and the instruments to carry out an environment protection policy in the Gambia.
    Part 1 contains not less than 13 pages of definitions used in the Act. Part II outlines the general principles of environment protection and confers certain powers upon the national Environment Agency established under Part III. Part III provides for a Council for the protection of the environment to be headed by the President of the Gambia and having several ministers as its members, and the establishment of the Agency aforementioned as a corporate body. The Agency shall coordinate the environment policy of the Government and function as the secretariat of the Council. Several national and local committees are also established. The Action Plan, prepared by the Agency shall be the key instrument for national environment planning. Also local planning units shall prepare local environment plans which shall be co-ordinated with plans made under the Physical Planning and Development Act (No. 1 of 1991) (Part IV). Part V requires a developer to submit environment project briefs and environmental impact statements for projects listed in the Schedule. Section 25 provides for environmental audits. The environmental standards specified in Part VI shall be established by the Agency. Part VII, dealing with environmental management, contains also several sections on coastal zone management. Part VIII provides summarily for the control of various forms of pollution. The remaining Parts deal with inspection and analysis (IX), education (X), offences (XI), legal proceedings (XII) and miscellaneous matters (XIII). (completed by 1 Schedule)

    This Law aims to improve and to protect the environment by handling the damages, protecting the public health and the natural resources. The Law establishes a Council for the protection and improvement of the environment referring to the Ministry of Environment and cooperating with other Ministries. It also defines its duties and responsibilities. Smaller Councils will be established in the different provinces of the country.
    The Law sets forth provisions for the protection of the environment. The regions responsible for environmental pollution have to use clean technologies and set up a suitable environmental policy. The use of sensors for pollution monitoring and control is recommended as well as the renewable energy technologies. An environmental impact assessment shall be done for any new project held in the country.
    The Law concerns also the protection of water from pollution. It regulates the discharge of effluents whether they are of domestic, industrial or agricultural origin.
    This Law covers as well the following subjects: regulation of air pollution and noise reduction; earth protection; biodiversity protection; management of hazardous waste; protection of the environment from pollution resulting from exploration and extraction of oil wealth and natural gas; establishment of an environmental protection fund; rewards; compensation for damages; and penal provisions.

    The Law repeals the Law No. 3 of 1997 on the protection and improvement of the environment.

    The Law further establishes a register of pollutants and of the transfer of contaminating materials. The register will be accessible to the public by the Internet, free of charge. Additional information on pollutant release and transfer will be made publicly available via a geographic information system (GIS), accessible on the Internet site of the Ministry of Environmental Protection.

    This Regulation provides for the protection of the environment and the ozone layer by giving the instructions for the use, import, and export of substances depleting the ozone layer.
    It is composed of 35 articles. Article 2: deals with some terms and definitions. Article 3: establishes a national committee of representatives of all ministries to be located in the Ministry of Environment and it will be concerned with the protection of the ozone layer. The objectives of this Committee are to : oversee the implementation of the national strategy to ensure the safety of the ozone layer, and establishing qualified training centers . Article 4: provides for the establishment of the Ozone Unit at the Ministry of Environment and for its competencies and duties. Article 5: prohibits the establishment of new industrial facilities or expansion of existing industries that use substances depleting the Ozone Layer (Annex 1). Article 6: prohibits the import or re-export of CFCS (Annex 2). The import of such substances should be only according to specific conditions mentioned in Articles 6 and 7. Any violation to the provisions of this Regulation will be penalized .

    Repeals: Instruction of 2003 controlling the use of materials depleting the ozone layer.

    This Law consists of 11 Chapters divided into 75 articles. Chapter I contains general provisions. Protection of the air is dealt in Chapter II. Protection of seas and marine resources is given in Chapter III. Protection of water resources is provided for in Chapter IV. Protection of food and foodstuffs is refered to in Chapter V. Chapter VI deals with environment saving. Chapter VII addresses the protection against common diseases. Chapter VIII relates to the protection of soil and plants. Protection of wildlife is given in Chapter IX. Transitional provisions are contained in Chapter X. Offences and penalties are given in Chapter XI. This Law provides for the protection of the environment from pollution including air, water, soil and food (art. 2). All concerned authorities shall adopt all best ways and methods for the protection of the environment (art. 6). Article 7 establishes the Technical Centre for the Protection of the Environment with the competence to lay down plans and programmes related to environment, environment protection, cooperation with international organizations in removing the causes of pollution, issuing permits, updating international agreements and treaties concerning environment, and to EIA. The Centre shall have the right to inspect concerned agencies and offices (art. 8). Article 17 provides for the control on the emission of smog generated by vehicles. Fishing gear and fishing methods, definition of meshes, and protected species are specified in articles 19-21. Provisions on pollution caused by ships and by oil are defined in articles 22 and 23. Concerned authorities shall define the list of ports for receiving waste disposal (art. 28). The Control Guide shall have the right to inspect ships (art. 32). It shall be prohibited to throw or drain waste and radioactivity materials in the sea (arts. 34-37).
